When a merchant openly sells counterfeit goods and encounters quality problems, how can the platform ensure "first-class" quality by favoring the merchant's second-hand products?

2024-01-29

In recent years, with the improvement of people's living standards and consumption ability, more and more idle goods need to be processed, and the demand for second-hand transactions is increasing, driving the rapid development of second-hand e-commerce platforms. The recycling of a large number of products also saves consumer expenses and reduces resource waste. However, in the context of the booming second-hand trading, a series of problems have also emerged: false advertising, proliferation of counterfeit goods, frequent fraud, illegal product sales, and frequent reports of negative and positive detection in newspapers. In order to safeguard the legitimate rights and interests of consumers and promote the standardized development of the second-hand trading market, the Rule of Law Jingwei Edition has launched a special column on "Legally Managing the Chaos of Second hand Trading" from today, and launched a series of investigation reports. Please stay tuned. Last December, Mr. Zhang, who lives in Xingtai, Hebei, spent 600 yuan on a second-hand trading platform to buy an electric car that had "normal functions" and looked newer from the pictures. Unexpectedly, after using it for a week, there were multiple product quality problems. "When I first rode, I found that the speed was very slow. At first glance, there was a problem with the converter. After riding for two days, the rear tire fell off directly, which turned out to be glued on. After repairing it, I rode again, but the battery couldn't be charged. I wanted to contact customer service for a return or exchange, but they didn't reply, and the platform phone number couldn't be reached. In the future, I won't buy anything on a second-hand platform anymore," Mr. Zhang said. In January of this year, Ms. Lin from Chaoyang District, Beijing, spent more than 9000 yuan on a second-hand trading platform to buy a luxury bag. However, she went to an inspection agency and found that it was fake. "At that time, the product details page clearly stated that it was a bag from a certain brand, and with the trust of the platform, I looked at the style and price, so I placed an order. Later, my best friend reminded me that the logo on this bag looked a bit different from the official one, and asked me to pay attention not to be fake. However, upon verification, it was indeed fake. I took the test report to customer service, but the other party did not solve the problem for me." Ms. Lin said. In life, some people find a brand new item too expensive and want to find a second-hand one to use; Some people feel that there is no place to store their old things at home and want to change their belongings to a new owner, while also cashing in some capital. From second-hand houses and cars to second-hand toys and clothes, buying and selling idle items has become a lifestyle for many people. It is understood that the number of users on the second-hand trading platform Xianyu has exceeded 500 million, and the number of online products has exceeded 1 billion. At the same time as the second-hand market is booming, there is a constant phenomenon of unscrupulous merchants passing off substandard goods and mixing genuine and fake products. Through keyword search on a third-party complaint platform, tens of thousands of complaints about second-hand goods related to "counterfeit goods" and "quality problems" can be found. Solving the pain points of second-hand transactions and buying low-priced, high-quality goods has become a common aspiration of many consumers. Last August, Ms. Li from Huizhou, Guangdong bought an Apple phone on a second-hand trading platform, priced more than 2000 yuan cheaper than the same phone in the second-hand market. "The seller said that due to the nature of their work, they couldn't use an Apple phone, so they wanted to sell it. I checked the phone's serial number and found no problem. The warranty period was nearly 200 days, and it was indeed cheap, so I placed an order. When I received the goods, I recorded an unboxing video and opened the phone, which showed that it was obviously counterfeit." Ms. Li said, "I have all the evidence."
