Standardizing Law Enforcement to Assist in Building a Beautiful China

Recently, the Ministry of Ecology and Environment issued a newly revised "Administrative Law Enforcement Inspection Measures for Ecological Environment" (hereinafter referred to as the "Measures"), which adjusted the main body and procedures of the inspection based on the actual situation of the vertical management system reform and comprehensive administrative law enforcement reform of environmental protection institutions below the province. A good ecological environment is the most inclusive welfare for people's livelihoods. Whether it is fighting the battle against pollution or defending the blue sky, clean land, and green mountains, strong ecological environment law enforcement is indispensable. In recent years, in order to enhance the unity, authority, and effectiveness of ecological environment law enforcement, China has continuously deepened the comprehensive administrative law enforcement reform of ecological environment protection, integrated and established a comprehensive law enforcement team for ecological environment protection. Currently, the first half of the reform is basically in place, and it is necessary to strengthen the construction of operational mechanisms and other aspects, do a good job in the second half of the reform, and make ecological environment law enforcement more standardized and efficient. As an important step and link in ecological environment law enforcement, inspection is not only a form of supervision over law enforcement behavior, but also a powerful tool for regulating law enforcement behavior and implementing internal correction. Previously, the former Ministry of Environmental Protection issued the "Measures for Environmental Supervision and Inspection", effectively improving the standardization level of ecological environment law enforcement in various regions. With the promotion of the vertical management system reform and comprehensive administrative law enforcement reform of environmental protection agencies below the provincial level, it is also necessary to revise the original methods, adjust the main body and procedures of inspections, in order to better promote strict, standardized, fair, and civilized law enforcement in the field of ecological environment. From a content perspective, the Measures have added provisions for holding individuals accountable for obstructing inspections and strengthened inspection guarantees. At the same time, provisions for fault tolerance and error correction, as well as due diligence exemption, have been added, clarifying seven situations such as not being held responsible for law enforcement errors. These regulations are the improvement and reconstruction of the inspection system, which helps to further strengthen the authority, professionalism, and rigor of inspection work, and also helps to enhance the confidence and enthusiasm of law enforcement personnel. In addition, the Measures have added non on-site inspections, specifying that inspections can be conducted through mobile law enforcement systems and other non on-site methods. If problems are found with clear facts and conclusive evidence, the inspection unit can directly provide feedback on the inspection results to the inspected unit. This is a response to China's continuous strengthening of administrative law enforcement informatization construction in recent years, which has positive significance for enriching inspection forms and improving inspection efficiency. A good ecological environment is an important foundation for building a beautiful China. We look forward to the strict implementation of the "Measures" by ecological and environmental departments in various regions, playing a good role in internal supervision of law enforcement inspections, regulating ecological and environmental law enforcement behavior, enhancing the authority and credibility of law enforcement, and better assisting in the construction of a beautiful China with blue skies, green land, and clean water.
