Looking Back at the 10th Anniversary of the Implementation of the Tourism Law, China's Achievements in Promoting and Managing Tourism in accordance with the Law

Starting from October 1, 2013, the Tourism Law of the People's Republic of China came into effect, marking a new stage in which China's tourism industry entered a comprehensive stage of promoting and governing tourism in accordance with the law. The Tourism Law is the first law in the history of China's tourism industry development, and this year marks the tenth anniversary of its promulgation and implementation. Looking back at the past decade, the Tourism Law has played a positive role in guiding, regulating, and safeguarding the legitimate rights and interests of tourists and tourism operators, regulating the order of the tourism market, protecting and reasonably utilizing tourism resources, and promoting the sustainable and healthy development of the tourism industry. Over the past decade, cultural and tourism authorities at all levels and the tourism industry have improved relevant supporting systems and working mechanisms, and increased tourism law enforcement efforts, Standardize the order of the tourism market, strengthen tourism safety supervision, strengthen the protection of the rights and interests of tourists, and make the tourism market more standardized and orderly. In the past decade, tourism operators have initially established the concept of operating in accordance with the law and fair competition. Tourists have continuously strengthened their awareness of protecting their rights and promoting civilized tourism in accordance with the law. The number of cases where judicial organs apply the Tourism Law to resolve tourism disputes has gradually increased, and the effectiveness of promoting and governing tourism in accordance with the law has been demonstrated. In the past decade, the position of tourism as a strategic pillar industry of the national economy has been further consolidated. The scale of the tourism industry has significantly expanded, and its role in promoting economic and social development has become more prominent. In the past decade, with the continuous growth of tourism travel rates, the tourism consumer group has become even larger, and tourism has become an important way of life for the people. The role of the tourism industry in meeting the spiritual and cultural needs of the people has become more prominent. The preliminary formation of the tourism regulatory system as an industry law has opened a new chapter in China's legal governance of tourism. Since 2013, the tourism department has formulated (revised) departmental regulations on tourism administrative penalties, credit management, online operations, and strengthened legal protection in key areas and links of tourism. As of now, 31 provinces (regions, cities) have comprehensively revised comprehensive tourism regulations, and some prefecture level cities have formulated and revised 123 regulations and rules, making useful supplements to the tourism law and playing a "small incision, small speed and flexibility" local legislative role. According to incomplete statistics, there are a total of 201 effective tourism laws, regulations, rules, and judicial interpretations in China, including 1 law, 3 administrative regulations, 12 departmental regulations, 1 judicial interpretation, as well as 184 local regulations, autonomous regulations, separate regulations, and government regulations, covering various fields of tourism such as food, accommodation, transportation, tourism, shopping, and entertainment. A tourism legal and regulatory system based on the Tourism Law, supported by regulations such as the Travel Agency Regulations and judicial interpretations, supplemented by administrative normative documents, has been preliminarily formed. At the same time, the tourism service standard system is constantly improving, playing a leading and supporting role in the high-quality development of the tourism industry through standardization. According to the data, there are currently 113 effective national and industry standards for tourism, including 36 national standards and 77 industry standards. A major highlight of the gradual improvement of the tourism market order in the tourism law is the great emphasis on protecting the rights and interests of tourists. Not only has a special chapter on "tourists" been established, clarifying that tourists have the right to information, choice, fair trade, and the right to request assistance and protection in dangerous situations.
