Premier Li Qiang of the State Council recently signed a State Council order, announcing the "Regulations on the Protection of Minors on the Internet" (hereinafter referred to as the "Regulations"), which will come into effect on January 1, 2024. The Central Committee of the Communist Party of China and the State Council attach great importance to the online protection of minors. In recent years, the rapid development of the Internet has expanded the learning and living space for minors, and has also sparked attention from the whole society to the issue of online protection for minors. The Regulations aim to create a network environment conducive to the physical and mental health of minors, safeguard their legitimate rights and interests, and provide strong legal protection for their online protection. The Regulations consist of 7 chapters and 60 articles, with a focus on the following provisions. One is to improve the network protection system and mechanism for minors. Clarify that the national network information department is responsible for coordinating and coordinating the network protection work of minors, and carry out the network protection work of minors according to their responsibilities. Clarify that the national press and publication department, film department, and relevant departments of the State Council, such as education, telecommunications, public security, civil affairs, culture and tourism, health and hygiene, market supervision and management, broadcasting and television, shall carry out network protection work for minors in accordance with their respective responsibilities. Clarify that local people's governments at or above the county level and their relevant departments shall, in accordance with their respective responsibilities, do a good job in protecting minors' networks. The second is to promote the internet literacy of minors. Clearly incorporate network literacy education into the content of school quality education. Request to improve the internet access conditions for minors and provide high-quality online literacy education courses. Strengthen the responsibility of schools and guardians for online literacy education, and establish a sound management system for students' online access during their school years. Clarify the functional requirements for juvenile network protection software and intelligent terminal products specifically designed for use by minors. The obligation to protect minors' networks shall be fulfilled by network platform service providers who have a large number of minors or have a significant impact on the minors' group. The third is to strengthen the construction of network information content. The state encourages and supports the production, reproduction, publication, and dissemination of online information that is conducive to the healthy growth of minors. Clarify the measures and reporting obligations for online product and service providers to handle information that poses a threat or may affect the physical and mental health of minors. Prohibit any organization or individual from engaging in online bullying against minors. Require online product and service providers to establish a sound mechanism for early warning, prevention, identification, monitoring, and disposal of online bullying. The fourth is to protect the personal information of minors. It is stipulated that guardians should educate and guide minors to enhance their awareness and ability to protect personal information, and guide minors to exercise relevant rights. Clarify the emergency response requirements for personal information processors in the event of or potential leakage, tampering, or loss of personal information of minors. It is stipulated that personal information processors should strictly set access permissions for minors' personal information and conduct personal information compliance audits. Clearly strengthen the protection of private information of minors. The fifth is to prevent minors from becoming addicted to the internet. Require teachers to improve their early identification and intervention abilities for underage students addicted to the internet, and strengthen guardians' guidance on the safe and reasonable use of the internet by minors. It is stipulated that internet service providers should reasonably limit the amount of consumption by minors of different age groups in using their services, and prevent and resist negative value tendencies such as traffic prioritization.
