How Law Enforcement and Judicial Institutions Protect Green Waters and Mountains from Three Reports

2023-10-23

The report of the State Council on cracking down on crimes in the field of ecological environment and resource protection, the report of the Supreme People's Court on the environmental and resource trial work of the People's Court, and the report of the Supreme People's Procuratorate on the procuratorial work of the People's Procuratorate on ecological environment and resource protection have recently been submitted for review at the 6th meeting of the 14th Standing Committee of the National People's Congress. This is the first time that the Standing Committee of the National People's Congress has simultaneously heard and reviewed the special work report on "one government, two courts" in the same field. Adhere to the strictest rule of law to protect the ecological environment and natural resources. The three reports of "One Government, Two Courts" have disclosed the measures and achievements of law enforcement, trial, and prosecution work in the past five years to organize a dense ecological environment and resource protection network. Xinhua Perspective reporters have sorted out this. Highlight 1: "Strict" - strict tone. From January 2018 to June 2023, the national public security organs registered 260000 cases of crimes against environmental and resource protection, and captured 330000 suspect, up 58.8% and 30.3% respectively from 2018 to 2022. In the past five years, the public security organs have been closely monitoring various environmental and resource related crimes, implementing a "all link, all elements, and all chain" crackdown - filing and investigating 32000 criminal cases of illegal occupation of agricultural land, and guarding the red line of 1.8 billion acres of arable land; We launched a special campaign to crack down on wildlife related crimes, and filed 108000 criminal cases and investigated them; We launched a special action to crack down on illegal fishing crimes in the Yangtze River Basin, and filed and investigated over 20000 criminal cases. From January 2018 to September 2023, courts nationwide concluded 1.47 million first instance cases of various environmental resources. The number of environmental resource first instance cases accepted from 2018 to 2022 increased by 76.7% compared to the previous five years. After continuous severe punishment, crimes related to environmental pollution have shown a downward trend. According to data from the procuratorial organs, from 2018 to June this year, 43000 people were examined and prosecuted for crimes related to environmental pollution. In 2022, it decreased by 31.7% compared to 2018. The data in the report strongly confirms the positive role played by the public security organs in maintaining ecological civilization over the past five years. With a 'zero tolerance' attitude, they have actively 'wielded their swords' against environmental and resource violations and crimes, forming a strict tone and consistently implementing it. Protecting green waters and mountains through legal means is more powerful and effective, "said Guan Yanjie, an associate professor at the People's Public Security University of China. Point 2: "Governance" - Promoting governance through case studies and implementing ecological judicial protection. In response to the exposed issues of crimes related to fishing and sand in the Yangtze River, the Ministry of Public Security, in conjunction with relevant ministries, has jointly solved over 1300 management loopholes in various regions. In response to the frequent occurrence of illegal "release" and chaos in some places, the people's court conducted a "legal popularization+science popularization" style live broadcast of the trial, and communicated and cooperated with relevant departments to interpret the law in a case by case, guiding the masses to rational and standardized "release". In response to the situation of pollution caused by inadequate mining and protection of manganese ore resources in a certain county, the procuratorial organs have integrated efforts to crack down on criminal offenses, supervise administrative violations, and safeguard public interests. In combination with case handling and issuing procuratorial recommendations, they have provided legal samples for comprehensive treatment of mining pollution... From "handling one case" to "governing one area", from "cracking down on local areas" to "focusing on the whole", as reflected in multiple cases in the report
