On August 3, the Beijing Internet Court held a press briefing on the trial of cases involving cyber violence and released typical cases involving cyber violence, calling on all social parties to jointly participate in the governance of cyber violence, strengthen the protection of personality rights and interests in cyberspace, and create a clean and healthy cyber ecosystem. It is reported that the cases involving cyber violence in the Beijing Internet Court are mainly online tort liability disputes raised on the grounds of infringement of personality rights such as reputation, privacy and personal information rights. Since its establishment in September 2018, the court has adjudicated a total of 465 cases of online infringement liability disputes with natural persons as plaintiffs, with reputation rights disputes accounting for 55.3% of the cases. Research has found that new forms of online violence are emerging one after another, with new forms of infringement such as "lottery forwarding" and "0.01 yuan link hanging", promoting the rapid and widespread dissemination of infringing information. In order to attract attention and traffic, some online Personal media, marketing accounts and online celebrities often create curious information, stir up netizens' emotions or follow the trend to hype hot events, triggering numerous post comments and then leading to online violence; Some teenagers have relatively insufficient judgment and are prone to being coerced by public opinion or blindly pursuing celebrities, participating in online violence activities; Some disputes occur offline, where infringers vent their anger or retaliate by publishing false information online, which spreads through online fermentation and triggers online violence. Some platforms have lax implementation of real name authentication, insufficient ability to intervene in and handle online violence, and rigid application of the "notice delete" rule, which has failed to effectively curb the spread of online violence. "The main difficulties in the trial of such cases are that it is difficult to directly lock the subject of infringement, that the infringement is complex and diverse, and that the consequences of infringement are difficult to quantify." Zhao Ruigang, member of the Party Leadership Group and vice president of the Beijing Internet Court, said that in the face of the new situation of judicial governance of cyber violence, the Court insisted on strengthening the network protection of personality rights and interests, and safeguarding the rights of cyber violence victims in accordance with the law,? Next to the fourth edition? Continuing from the first version, we will resolutely punish acts of online violence and infringement, implement and strengthen platform responsibility in accordance with the law, determine the verification and attention obligations of the "Internet Big V" in accordance with the law, and continuously explore and improve the judicial concepts and rules for cases involving online violence. The court suggests that online platforms should improve the mechanism for identifying and judging online violence as soon as possible, strictly punish and punish accounts related to online violence in accordance with the law, and strictly prevent the spread of online violence information; The online media strictly abide by professional ethics and strengthen the positive publicity of the content that conforms to the Core Socialist Values; The vast number of internet users use the internet scientifically and in accordance with the law, widely gathering upward and good forces in the cyberspace, so that positive energy always fills the cyberspace. The Beijing Internet Court will further convey the concept of 'cyberspace is not an illegal place' to society through the release of typical cases of online violence, various forms of legal education activities, and the production of online legal education videos, guiding netizens to jointly build a beautiful spiritual home.
