"On April 10th, the public interest litigation prosecutor of Yixing City Procuratorate in Jiangsu Province came to a village in Dingshu Town to review the restoration of damaged farmland. The party branch secretary of the village told the prosecutor about the effect of reclamation. A few months ago, there were only two fish ponds, nine houses, and a football field on this arable land. In 2013, Fan, a villager from a certain village in Dingshu Town, found 21 farmers in the village and signed a land transfer agreement with them. He paid the corresponding land transfer fees to the farmers every year and obtained the right to use 29.7 acres of land. Starting from 2014, Fan dug a pond on the land to raise fish, and the soil excavated from the pond was transported to plant trees. Gradually, Fan's "territory" grew larger and larger, not only planting trees on some land, but also creating a football field, several houses, and chicken duck goose coops. Through continuous renovation and expansion, Fan's "private farm" equipped with a football field has gradually formed a "scale". Until 2020, Fan's behavior was discovered by the national land authorities during inspections, and the national land authorities transferred the case clues to the public security organs for investigation. In August 2021, the case was transferred to the Yixing City Procuratorate for examination and prosecution. After examination, it was found that Fan's renovation and expansion activities did not obtain any land use procedures, violating the provisions of the Land Management Law on the approval procedures required for the conversion of agricultural land to construction land. Among the illegally occupied farmland, 7.66 acres of basic farmland have been hardened and damaged, with a damage level of three, which is considered serious damage. Fan's actions are suspected of the crime of illegally occupying agricultural land. At the same time, the court believed that Fan's actions had harmed national food security and social public interests, and therefore filed a public interest lawsuit against Fan for investigation. After multiple supplementary evidence and commissioned reclamation evaluations, in August 2022, the Yixing City Procuratorate brought the case to court and requested Fan to pay the reclamation costs assessed in the reclamation plan or to repair and bear the transaction costs of the case on his own.
