The first instance of the Fangshan District People's Court of Beijing held that the defendants, Cui and Huang, used fraud to raise funds illegally for the purpose of illegal possession, and the amount was huge. Their behavior had constituted the crime of fund-raising fraud, and should be punished according to law. Because they defrauded the money of the elderly, they should be given a heavier punishment. Accordingly, the court of first instance sentenced Cui to eight years' imprisonment and fined 800000 yuan for the crime of fund-raising fraud; Huang was sentenced to seven years' imprisonment and fined 500000 yuan; Order Cui and Huang to refund and compensate the economic losses of each fund-raising participant; Freeze the deposit in the bank account under the name of the defendant Cui, and return it to the fund-raising participant. After the judgment was pronounced, the defendant Cui Mou filed an appeal, and the second instance ruling of the Beijing Second Intermediate People's Court upheld the original judgment. Now the judgment has taken legal effect. This case was selected as a typical case in the special action of the Beijing court to crack down on pension fraud. In this case, the two defendants used false identity information in the name of responding to national policies, fabricated investment projects, used huge returns as bait to defraud the elderly of investment funds, then transferred funds, disguised the nature of funds and squandered them wantonly. Of the more than 3000 people cheated, 3574 were elderly people, and most of the money invested by the elderly was pension money. In order to ensure that the lost elderly can recover their losses and enjoy their old age safely, the court took the recovery of stolen goods as one of the key points of the trial work in the process of handling the case, and took measures to seal up, detain and freeze the defendant's property according to its authority, to ensure that the recovery should be made as soon as possible, the refund should be made as soon as possible, and the compensation should be made as soon as possible, and to recover more than 5.8 million yuan of the case money for 3574 elderly people, to minimize the economic losses of the cheated elderly. In addition to quickly and efficiently adjudicating criminal cases involving pension fraud according to law, the Fangshan District Court took multiple measures and made efforts to actively promote a series of special actions in comprehensive governance, clue screening, law popularization and publicity, and made every effort to safeguard the long-term stability of the Party and the country, the harmonious development of society, and the people's living and working in peace and contentment.
