The reporter learned from the Supreme People's Procuratorate: from June 2019 to June 2022, the procuratorial organs prosecuted more than 18000 key crimes such as counterfeiting registered trademarks, colluding in bidding, infringing trade secrets, and false advertising, and more than 41000 people, including more than 7400 cases of counterfeiting registered trademarks, more than 15000 people, more than 2300 cases of colluding in bidding, more than 7000 people, and more than 130 cases of infringing trade secrets. It is reported that the crimes of disrupting the order of market competition are generally intellectual crimes, and the perpetrators often take normal production and business activities as a cover, which is somewhat confusing. With the development of modern science and technology such as the Internet, big data and artificial intelligence, the means of crime continue to be renovated and are highly professional. It is more difficult for judicial organs to crack down on and prevent crimes. In addition, due to the different levels of economic and cultural development and long-term behavior habits in economic activities, there are great differences in the fields and means of committing crimes that disrupt the market competition order. Generally speaking, the crimes of disrupting the market competition order are more prominent in economically developed areas. The types of unfair competition behaviors involved in the above areas are relatively more diverse. There are more new cases and the cases are more complicated. The relevant person in charge of the Supreme People's Procuratorate said that in judicial practice, some acts that disrupt the market competition order are classified as civil disputes, administrative violations or criminal crimes according to the degree of violation and the degree of impact. Judicial organs must adhere to the modesty of criminal law, accurately distinguish the nature of acts, and distinguish between civil disputes, administrative violations and criminal crimes.
