Zhang Tao pointed out that according to the regulations on the prohibition of MLM, MLM refers to the behavior of organizers or operators' development personnel to seek illegal interests, disrupt economic order and affect social stability by calculating and paying remuneration to the developed personnel based on the number of personnel they develop directly or indirectly or sales performance, or requiring the developed personnel to obtain membership qualification on the condition of paying a certain fee. For example, some apps encourage users to develop offline. In recent years, relevant departments have announced many cases of online pyramid selling using apps. Driven by some interests, people lack the ability to distinguish, and are easy to "get caught". He added that the existing laws stipulate the types of MLM, but do not further specify the specific judgment standards. Unclear illegal standards will also encourage operators' speculative behavior. It is suggested that the specific judgment standards of MLM should be stipulated for the new types of online MLM. "Previously, some apps that were suspected of online pyramid selling due to the offline development of 'pull people' were investigated and removed from the shelves, and many of them appeared on the shelves again as another app through 'transformation'." Zhang Tao believes that this is related to the low requirements for the review obligation of the application platform in the current regulations on the management of mobile Internet application information service (hereinafter referred to as the regulations). "We should focus on strengthening the obligations of the application platform in laws and regulations." Zhang Tao pointed out that the draft for comments on the revision of the administrative provisions issued in January 2022 has greatly strengthened the review obligation of the application platform, requiring the application distribution platform to establish and improve management and technical measures to timely detect and prevent application violations. It can be considered to use the application for MLM as one of the illegal acts that the application platform should find and prevent in time. At the same time, the application platform should be guided to carry out special supervision on the applications that adopt a similar "pull the head" marketing mode.
