In May 2018, the defendant Zhang organized more than 20 people to gamble in the wechat group established by him in Haidian District, Beijing, took the lottery results on the lottery website as the betting object, and set the gambling rules such as "dragon", "tiger" and "harmony". The defendant Dong also directly organized personnel to participate in gambling. During the court trial, the public prosecution showed the defendant's confession, the witness's testimony, on-site inspection records, screenshots of wechat transaction records and chat records, screenshots of information sent by wechat group, screenshots of gambling rules information released by wechat group and other evidential materials, and considered that the acts of the defendants Zhang and Dong constituted the crime of opening a casino. After hearing, the court held that the defendants Zhang and Dong established a wechat group to provide places for gambling for the purpose of profit, set their own gambling rules according to the lottery results of the lottery website, accepted the bets of gamblers, and obtained the rebate of the gambling website. The gambling capital accumulated more than 400000 yuan. The circumstances are serious. Their acts have constituted the crime of opening a casino and should be punished. In view of the fact that the defendant Zhang has the plot of voluntary surrender, the defendant Dong is an accomplice, and can truthfully confess his crime after arriving at the case and during the court trial, and has a good attitude of pleading guilty, both defendants shall be given mitigated punishment according to law.
