The reason for this is related to the newly revised "Express Delivery Market Management Measures" (hereinafter referred to as the "Measures") that came into effect on March 1st. The Measures clearly stipulate that enterprises engaged in express delivery business shall not confirm receipt of parcels on behalf of users without their consent, nor shall they deliver parcels to intelligent express boxes, express service stations and other express end service facilities without authorization. If there is a violation and the circumstances are serious, a fine of not less than 10000 yuan but not more than 30000 yuan shall be imposed. "The Measures have played a positive role in regulating the development of the express delivery industry and protecting the legitimate rights and interests of consumers." Chen Yinjiang, Deputy Secretary General of the Consumer Rights Protection Law Research Association of the China Law Society, pointed out in an interview with the Legal Daily that in the process of implementing the new regulations, attention should be paid to comprehensively considering the interests of consumers, express delivery practitioners, and other parties, truly promoting the sustainable, healthy, and high-quality development of the express delivery industry. According to the latest statistical data from the State Postal Administration, the cumulative volume of express delivery business in China reached 132.07 billion in 2023, a year-on-year increase of 19.4%. Violent sorting by courier companies resulting in damage to items; The courier's failure to contact the recipient after delivering the item resulted in the loss of the package... It has been a common occurrence for consumers to experience poor online shopping due to inadequate courier services. In Chen Yinjiang's view, although the express delivery industry is becoming increasingly closely connected with the public, it still belongs to the emerging industry spawned by the rapid development of e-commerce, and many practical problems urgently need to be standardized. In recent years, relevant departments have introduced relevant regulations for the express delivery industry and continuously standardized express delivery services. The Provisional Regulations on Express Delivery (hereinafter referred to as the "Regulations") implemented in 2018 have put forward relevant requirements for improving the quality of express delivery services and protecting the personal privacy of users. There are also clear regulations regarding the current hot topic of "door-to-door services", which require companies operating express delivery services to deliver parcels to the agreed delivery address, recipient or designated recipient's representative, and inform the recipient or representative to inspect them in person. However, the actual implementation of this regulation is not in place. Chen Yinjiang believes that the root cause is that the Regulations have not set corresponding penalties, which has caused express delivery companies to not take this seriously. In contrast, Article 28 of the Measures not only explicitly uses the phrase "without the user's consent" and "not to deliver parcels to intelligent express boxes and other express delivery end service facilities without authorization", but also emphasizes the protection of consumer choice rights and sets clear penalty rules, which can greatly deter express delivery enterprises and increase their attention. In addition to the problem of door-to-door delivery, the Measures also made targeted provisions for many consumers' roast about violent sorting and other acts, specifying that express enterprises should not throw or trample on express mail. If the violation of relevant provisions is serious, a fine of more than 10000 yuan but less than 30000 yuan will be imposed. The Measures also regulate the comprehensive strengthening of user personal information security protection and the promotion of green and low-carbon development in the express delivery industry. "The 'Measures' make clear provisions in strengthening the regulation of express delivery service behavior, strengthening market system management requirements, and other aspects, which helps to further promote the sustained and healthy development of the express delivery industry."
