Guangdong plans to legislate to ensure the deepening of comprehensive cooperation between Guangdong, Hong Kong, and Macao towards the world in Nansha, Guangzhou. The website of the Standing Committee of the Guangdong Provincial People's Congress recently published the "Nansha Deepening Guangdong Hong Kong Macao Cooperation Regulations (Draft for Comments)" (hereinafter referred to as the "Draft for Comments"), which was publicly solicited from all sectors of society from December 8 to January 5, 2024. The draft for soliciting opinions is intended to clarify the responsibilities of the provincial and municipal governments in the construction of Nansha from the perspective of provincial regulations, and plans to make provisions in areas such as scientific and technological innovation, industrial development, open cooperation, urban development, rule linkage, and comprehensive protection. Establishing a green channel for handling matters related to Nansha is the responsibility of the provincial government and departments. The draft for soliciting opinions clearly states that the provincial government should strengthen overall coordination, resource guarantee and policy support, enhance communication and consultation with the governments of the Hong Kong Special Administrative Region and the Macao Special Administrative Region, and promote the resolution of major issues in the construction and development of Nansha. The Office of the Leading Group for Promoting the Construction of the Guangdong Hong Kong Macao Greater Bay Area in Guangdong Province shall be responsible for coordinating relevant units in Guangdong Province to support the construction and development of Nansha. The relevant departments of the provincial government should formulate policies and measures to promote the construction and development of Nansha within their respective responsibilities, establish green channels for handling matters related to Nansha, support major project construction and institutional mechanism innovation. Focusing on decentralization, the provincial government and its relevant departments, as well as the Guangzhou municipal government and its relevant departments, should, in accordance with the needs of Nansha construction and development, authorize or entrust the Nansha District government and relevant departments to exercise the relevant provincial and municipal management powers in accordance with the principle of "if possible, then release" and relevant procedures. At the same time, according to the needs of the construction and development of Nansha, after obtaining national consent in accordance with relevant procedures, the national management authority undertaken can be authorized or entrusted to the Nansha District Government and relevant departments in accordance with the law. The draft for soliciting opinions stipulates that Nansha should be encouraged and supported to boldly explore and experiment in important areas and key links of reform and opening up within the framework of the rule of law, taking into account its actual situation; For errors or deviations in exploration that meet the prescribed conditions, liability may be exempted or reduced. Supporting the free flow of cross-border scientific research materials in Nansha and focusing on technological innovation, a series of detailed regulations are proposed in the draft for soliciting opinions. For example, in terms of introducing scientific research talents, the draft for soliciting opinions proposes that the provincial government and its relevant departments should support the reform and innovation of scientific research personnel introduction, management, and incentive mechanisms in Nansha, encourage the establishment of technology-based enterprises in Nansha, and international talents who meet the conditions and obtain permanent residency qualifications in mainland China can serve as the legal representative of scientific research institutions in Nansha. The transfer and transformation of scientific and technological achievements that many scientific researchers are concerned about are also reflected in the draft for soliciting opinions. It is proposed that higher education institutions, scientific research institutions, and other units established in Nansha using fiscal funds can explore granting full or partial ownership or long-term use rights of scientific and technological achievements to those who have completed them, in accordance with relevant national regulations, without harming national security, national interests, and major social public interests. In terms of tax incentives for science and technology innovation, the draft for soliciting opinions stipulates that for high-tech key industry enterprises established in Nansha, those who meet the qualifications of high-tech enterprises or technology-based small and medium-sized enterprises in the current year, their losses incurred in the eight years before the qualification year that have not been fully compensated shall be carried forward in accordance with national regulations
