2023-08-15

Contract online signing refers to operating through a unified elderly care service management information system, and the online signing contract comes with a watermark to prevent forgery. At the same time, the entire process of contract online signing is marked, and industry management departments can understand the utilization rate of institutional beds, service personnel allocation, and other situations, providing decision-making basis for the supply of elderly care services and resource allocation in the city. The online signing work is designed and considered to protect the rights and interests of the elderly. The entire contract process is paperless and networked, with secure and reliable storage, which is conducive to further regulating the service supply of elderly care institutions, strengthening the supervision of service behavior processes, and safeguarding the legitimate rights and interests of both parties. Difficulty in refunding fees, inconvenience in signing contracts, and constant "domineering clauses"... With the continuous development of the elderly care industry, disputes involving elderly care service contracts are becoming increasingly common. Some enterprises and elderly care institutions attract elderly people to sign elderly care contracts and engage in large-scale recharge consumption in the name of providing convalescent services, paying prepayment to obtain membership and point consumption. The Supreme People's Court has announced a number of typical cases of protecting the rights and interests of the elderly this year, similar to the contract disputes mentioned above, which involve complaints in the field of elderly care services in severely affected areas. Taking Beijing as an example, in 2022, the 12345 Citizen Service Hotline received a total of 2262 related complaints, of which more than half reported difficulties in refunding fees, inconvenience in signing contracts, and the existence of "domineering clauses" in contracts. In order to further standardize the supervision of elderly care institutions' contracts and protect the rights and interests of the elderly, in March of this year, Beijing pioneered the implementation of online signing of elderly care service contracts nationwide. As of now, all elderly care institutions in Beijing have implemented online signing of elderly residency contracts, and more than 480 institutions have completed the signing of over 12000 online signing contracts. With the increase of new elderly residents and the gradual expiration of existing paper contracts, the number of online signed contracts continues to grow. Contract online signing refers to operating through a unified elderly care service management information system, and the online signing contract comes with a watermark to prevent forgery. At the same time, the entire process of online contract signing is left with traces, and industry management departments can timely grasp information on the admission, discharge, and service changes of the elderly, understand the utilization rate of institutional beds, service personnel allocation, and other situations, and provide decision-making basis for the supply of elderly care services and resource allocation in the city. The disputes over elderly care services are mainly manifested in the inconsistency between contract agreements and performance. The online signing work is designed and considered around protecting the rights and interests of the elderly. As providers of elderly care services, elderly care institutions have the responsibility to actively prevent and handle disputes related to elderly care services. "Shang Zhenkun, Deputy Director of the Beijing Elderly Care Service Center, believes that the online signing contract adopts the demonstration text of the" Beijing Elderly Care Service Contract "jointly revised by the Beijing Municipal Civil Affairs Bureau and the Beijing Municipal Market Supervision Administration, which is paperless throughout the entire process Networked signing, secure and reliable storage, is conducive to further regulating the service supply of elderly care institutions, strengthening the supervision of service behavior processes, and safeguarding the legitimate rights and interests of both parties. From the feedback of usage, the elderly, their families, and elderly care institutions generally give positive evaluations to the online signed version of elderly care service contracts. According to relevant regulations, service contracts require elderly care institutions to fill in charging items item by item, and limit the collection of prepaid funds to no more than four times the monthly elderly care service fee standard. If the monthly fee of a nursing home is 5000 yuan, the prepayment cannot exceed 20000 yuan. This is both convenient
