Since November last year, the China Association for the collective administration of audio and video copyright, in conjunction with the China Association for audio and video and digital publishing, has conducted three rounds of rate negotiations with the Supreme People's court stakeholders, lawyers, experts and scholars, representatives of live broadcasting platforms and other parties under the guidance of the national copyright administration. According to Article 45 of the newly revised copyright law, the association confirms that the anchor and platform need to pay the copyright fee to the obligee and recording producer of music works when using relevant music. In terms of specific charging standards, the association divides the types of live broadcasting rooms into three categories, namely, live broadcasting rooms that use karaoke + background music, live broadcasting rooms that only use background music, and e-commerce live broadcasting rooms that use music. The charge standard is divided into annual charge, quarterly charge and monthly charge. Among them, the live broadcasting room of karaoke + background music: the annual fee is 300 yuan, the quarterly fee is 83 yuan, and the monthly fee is 29 yuan. The live broadcasting room using background music only: the annual fee is 100 yuan, the quarterly fee is 26 yuan, and the monthly fee is 10 yuan. The live broadcasting room of e-commerce using music: the annual fee is 10000 yuan, the quarterly fee is 2777 yuan, and the monthly fee is 980 yuan. It is worth mentioning that some anchors said that the platform has deducted part of its revenue, For example, only part of the gifts painted by users can belong to the anchor. Therefore, the anchor hopes that the platform will bear the copyright cost, otherwise many anchors may not use music in the future. In this regard, the association said that in order to effectively implement the payment standard, the trial standard is oriented to the platform, and then the cost is shared by the platform and the anchor. Yaohuanqing, Deputy Secretary General of China Intellectual Property Law Research Association and professor of Renmin University of China, said that after the network platform signed the payment agreement with the collective management organization, the music library was open to the anchor, and the anchor could also obtain such music resources at a low cost. If such a synergy can be achieved, it may actually be beneficial to the development of the entire network ecosystem. Liu Yang, vice chairman and Secretary General of the digital music Working Committee of the China Association of audio visual and digital publishing, said that many live broadcasting platforms are very willing to implement this matter as soon as possible. Therefore, the association hopes to use the trial payment standard to connect the live broadcasting room, anchor and obligee, so as to maximize the efficiency of industry development. According to the statistical report on the development of China's Internet, the number of live webcast users in China reached 703million in 2021. Therefore, under the premise of ensuring the legitimate rights and interests of music rights holders, it is very beneficial to promote the vigorous development of the internet live broadcasting industry.
