Ms. Wang, a citizen of Xinghua, Jiangsu, who was deeply troubled by postpartum obesity, saw her good friend Jiang in the wechat circle of friends sharing an article about the obvious weight-loss effect of "Star Coffee". After consulting, she learned that Jiang's mother, Chen, was a wechat agent. With the mentality of trying, she bought a box from somewhere Chen. Unexpectedly, she suffered from dizziness, insomnia and other adverse symptoms after drinking it for a few days. After searching on the Internet, she found a large number of information reflecting that "Star Coffee" contained sibutramine. She hurried to find Chen for advice, but the other party was evasive. The market supervision and administration sent the coffee to Taizhou Institute for drug control for identification. It was found that sibutramine, an ingredient prohibited by the state to be added to food, could lead to elevated blood pressure, heart failure, even stroke and sudden death after long-term use. The market supervision and management department transferred the clue to the public security organ, promptly filed a case for investigation on suspicion of selling toxic and harmful food, and arrested Mr. Chen. He seized 300 bags of weight-loss coffee and 975 weight-loss chocolates that had not been sold on the spot. All of them were identified by Taizhou drug inspection Institute as containing sibutramine. After the police arrested Mr. Chen, two of his online friends, Mr. Wang and Mr. Song, surrendered one after another. According to statistics, the accumulated sales profit of the three persons is more than 39000 yuan. The case was transferred to Xinghua procuratorate for examination and prosecution. After examination, it was found that during the period from September, 2020 to January 11, 2021, Chen and other three suspect knew that the "slimming coffee" and "slimming chocolate" sold were mixed with toxic and harmful non food raw material "sibutramine", and they were still selling in the circle of friends for profit, which had constituted the crime of selling toxic and harmful food. At the same time, the acts of the three persons infringed upon the health of the unspecified public and damaged the public interest, which met the conditions for filing a criminal incidental civil public interest litigation. On December 31, 2021, the Xinghua municipal procuratorate filed a criminal and incidental civil public interest lawsuit against the three defendants, requesting the three defendants to bear a punitive compensation of 161500 yuan for the consumer's losses and ten times the income. On February 25, 2022, the Xinghua people's court sentenced the three defendants to imprisonment ranging from one year of fixed-term imprisonment to eight months of fixed-term imprisonment with a fine. At the same time, it accepted all the requests of the procuratorial organ for incidental civil public interest litigation. In addition to Ms. Wang, another 34 victims of the case purchased this coffee, distributed in Heilongjiang, Gansu, Yunnan and other places. In order to distribute the compensation to the victims as soon as possible, the Xinghua municipal procuratorate and the municipal market supervision and Administration Bureau jointly prepared a notification letter to explain the handling of the case and the receipt of compensation, and inform the victims by letter. The procurator in charge said that the sale of toxic and harmful food seemed to be profitable in the short term, but it was a dream of making money in vain. For consumers, eating these foods may cause physical damage. For sellers, once the case is committed, they will inevitably be investigated for criminal responsibility, and may also pay high compensation, which is really harmful to others but not to themselves. Food is the most important thing for the people. Food safety is a major livelihood event related to everyone's health and life safety. Food salesmen must fulfill their legal obligations to ensure food safety, prohibit the sale of products with unknown origin, incomplete identification and safety risks, and consciously be the guardian of food safety. As for consumers, if they are damaged by buying food that does not meet the food safety standards, they can obtain compensation according to the law.
