Standardize the "signed express" so that consumers can enjoy more comfortable services

2022-01-11

According to the Beijing Youth Daily, on January 7, the State Post Office publicly solicited opinions on the measures for the administration of express market (Revised Draft), which intends to make it clear that those who confirm the receipt of express mail without the user's consent or use intelligent express boxes or express service stations to deliver Express mail without permission shall be ordered by the postal administration department to make corrections, circulate a notice of criticism and be fined more than 3000 yuan A fine of less than 10000 yuan; If the circumstances are serious, a fine of not less than 10000 yuan but not more than 30000 yuan shall be imposed. The postal administration encourages the general public to call 12305 to appeal and protect their rights in the future. Nowadays, online shopping and express delivery have become a part of many people's lives. In order to improve distribution efficiency and reduce operating costs, some express enterprises or couriers often sign for express without the knowledge of the recipient, or deliver the express to the express service station. This not only infringes on the rights and interests of consumers, but also reduces their obligations. Now, relevant departments intend to stop this "hidden rule", which is expected to improve the express consumption experience, make the service of express enterprises more standardized and no longer fool consumers. In daily online shopping, most people want to receive express delivery in person, that is, through face-to-face inspection to determine whether to return goods or claim other rights from businesses. Even if it is temporarily impossible to collect the express in person, consumers also hope that the courier will sign for it or deliver the express to the service station after asking for their consent, so as to know the arrival time of the express and retrieve the express in time. If people send and deliver valuables, it is more necessary for the courier to personally deliver the items to the recipient in order to reduce the risk of loss and damage. It should be clear that it is the legal obligation of the express enterprise to deliver the express to the recipient and sign for it. Article 25 of the Interim Regulations on express delivery clearly stipulates that an enterprise engaged in express delivery business shall deliver the express to the agreed receiving address, the recipient or the agent designated by the recipient, and inform the recipient or agent to accept it face to face. The addressee or agent shall have the right to accept in person. However, in view of the fact that some consumers and couriers agree to temporarily store the express to the guard or express post station, it is more common in reality, and this also saves the delivery time for the couriers. As a result, the practice of signing in and delivering to the service station has become a "hidden rule" over time, Some express companies even directly sign express or deliver express to express stations without informing the recipients. Generally speaking, when the express is signed, the risk of loss and damage is borne by the recipient. Moreover, the exercise of the right to "return goods for seven days without reason" in online shopping and the time when the third-party payment platform pays to the merchant are calculated from the time when the express is signed in. In other words, during the period when the express is signed but not actually delivered to the recipient, the recipient needs to bear additional risks. Express delivery is a paid business service, not a friendly act of "carrying goods" between relatives, friends and neighbors. This determines that express delivery enterprises must standardize and successfully complete delivery, and must not be opportunistic, discount their obligations in disguise, and impair the rights and interests of consumers. It is expected that with the efforts of many parties, "received express" can become the past tense as soon as possible, and the express service can be more standardized, more considerate and more satisfactory to consumers.
