2023 is a year of comprehensive outbreak of artificial intelligence technology, with more and more artificial intelligence applications going online and rapidly becoming popular worldwide. Artificial intelligence has brought great convenience and opportunities to social life and business activities, but it has also spawned a series of social, ethical, safety, and legal issues, attracting widespread public attention. During this year's National People's Congress, several representatives proposed a proposal to formulate the Artificial Intelligence Law, proposing to conduct legislative research on various legal issues arising from the development and rise of artificial intelligence, and timely formulate the Artificial Intelligence Law. The proposal believes that due to the rapid development of artificial intelligence technology, the existing legal system is insufficient to fully address and connect various problems caused by artificial intelligence technology, resulting in obvious lag and gaps. Therefore, relevant laws should be updated and amended in a timely manner. At the same time, it is difficult to handle legal issues related to the ethics of artificial intelligence technology, and there are many controversies in the academic community. We should actively carry out legislative research to prepare legal reserves for the emergence of related ethical issues, encourage in-depth academic exchanges and discussions in the field of artificial intelligence legislation, and lay a solid theoretical foundation for the comprehensive legislative work on artificial intelligence related issues. It is understood that on July 14, 2023, the State Internet Information Office, together with the National Development and Reform Commission, the Ministry of Education, the Ministry of Science and Technology, the Ministry of Industry and Information Technology, the Ministry of Public Security, and the State Administration of Radio and Television, issued the Interim Measures for the Management of Generative AI Services (hereinafter referred to as the Interim Measures), which will be implemented on August 15, 2023, becoming the main law and regulation in China to promote the healthy development and standardized application of generative AI at this stage. However, the proposal believes that the "Interim Measures" still cannot comprehensively cover various problems caused by artificial intelligence and are not sufficient to do a good job in connecting with current laws. It is recommended to summarize and improve the implementation experience of the "Interim Measures", timely formulate the Artificial Intelligence Law, make comprehensive provisions on legal issues related to artificial intelligence, and connect the gaps between various laws formed by the rise of artificial intelligence technology.
