Recently, the National Internet Information Office publicly solicited opinions on the "Regulations on the Security Management of Facial Recognition Technology Application (Trial) (Draft for Soliciting Opinions)" (hereinafter referred to as the "Draft"), once again sparking public attention to facial recognition technology. Standardizing the application of facial recognition technology has increasingly become a public demand. The "Opinion Draft" covers the requirements for the application scope, scenarios, usage purposes, and information protection evaluation of facial recognition technology, aiming to achieve full process standardization and full element supervision of facial recognition technology application. The Opinion Draft clearly stipulates that facial recognition technology can only be used to process facial information when it has a specific purpose and sufficient necessity, and strict protective measures are taken. This means that any unit or individual who wants to collect and use facial recognition technology must comply with this basic principle. For some specific scenarios, the "Opinion Draft" has drawn a "red line", explicitly prohibiting the use of facial recognition, such as hotel rooms, public bathrooms, changing rooms, bathrooms, and other places that may infringe on the privacy of others, and prohibiting the installation of image capture and personal identity recognition devices. The "Opinion Draft" also responded to the issue of facial recognition in properties with high attention to people's livelihood, clarifying that facial recognition technology should not be used as the only way to enter and exit property management areas, in order to eliminate the chaos of property service enterprises abusing facial recognition technology. The publication of the Opinion Draft effectively fills the gap in the lack of specific normative legal basis for the application of facial recognition technology. With the development of technology and the expansion of application scenarios, new problems and challenges in the field of facial recognition technology will continue to emerge in the future. Therefore, standardizing the application of facial recognition technology requires long-term efforts, which requires us to truly integrate facial recognition technology into the track of legalization and standardization. On the one hand, continuously improve laws and regulations in practice, and further refine the design of institutional mechanisms; On the other hand, while strengthening supervision and law enforcement by relevant departments, the role of social supervision should be fully utilized.
