Strengthening the Rule of Law in Maritime Gardens: Deepening the Integration of Prosecutorial Public Interest Litigation and Promoting the Protection, Use, and Governance of the Sea in Wenzhou Dongtou

In August, on the sea surface of Niyu Island in Dongtou District, Wenzhou City, Zhejiang Province, there were rippling blue waves and low flying seagulls. The beautiful scenery of the sea and sky was pleasing to the eye. Rows of seaweed planted on the sea surface extended from the shore, creating a magnificent sight. This year, my family's seaweed production is expected to reach 10000 kilograms, which has already been booked. A year ago, there were often dump trucks here, which could easily lead to seaweed rotting roots, and we were worried about planting anything. Now that the seaweed planting environment near the coast of Niyu has greatly changed, there is no need to worry about seaweed being contaminated by mud. Recently, when the prosecutor of Dongtou District Procuratorate came to Niyu Coast to "look back", Mr. Chen, a farmer, sighed. It is understood that Dongtou District is one of the 14 island districts (counties) in China, with a blue territory of 2708.7 square kilometers and the second largest fishing ground in Zhejiang. Since using the rule of law to protect the Blue Bay and launching a "combination punch" for ecological protection, there have been frequent incidents of illegal dumping in the Dongtou sea area, which not only damaged the marine ecology, but also caused damage to crops such as seaweed and sargassum fusiforme in the aquaculture area. Local people have strongly expressed this. At the beginning of 2022, the Dongtou District Procuratorate received the aforementioned situation reflected by the district people's congress representatives during the visit. The court promptly intervened, guided administrative agencies to investigate and collect evidence, and commissioned appraisal on the ecological damage caused by illegal dumping. After investigating the facts, the court filed a civil public interest lawsuit in August of the same year in accordance with the law. Later, the court ruled that three construction waste disposal enterprises should bear more than 270000 yuan in compensation for public interest damages. At the same time, the court issued procuratorial recommendations to urge the competent authorities to strengthen inspections and punishments, impose top punishment on those responsible, and clean up illegal dumping of over a thousand tons. After the case, the court submitted a special report to the district committee and government, promoting the illegal dumping and rectification of construction waste throughout the district, and assisting in creating an application scenario of "one thing supervision" for construction waste. After more than a year of efforts, the rectification effect is obvious. Data shows that in the first half of this year, the number of illegal dumping cases in Dongtou District decreased by more than 70% year-on-year. The handling of this case is a microcosm of the series of activities carried out by the Dongtou District Procuratorate to protect the Blue Bay. In recent years, the hospital has been deeply involved in key areas such as marine ecology, marine resource protection, and maritime safety and order. It has established a mechanism for inspecting bays, beaches, and coastlines, promptly identifying clues of damage to the marine environment, and urging functional departments to perform their duties in accordance with the law and restore marine ecology through procuratorial suggestions. Responding to concerns about good governance and drawing a "reality map" of resource utilization, Dongtou District has emerged and developed alongside the sea. However, for a long time, some aquaculture areas have been in a state of extensive utilization and disorderly control. The Dongtou District Procuratorate, in response to issues such as pollution and navigation safety hazards caused by illegal aquaculture of seawater, has conducted multiple thematic studies with functional departments, inviting superior natural resources departments to provide professional guidance in Dongtou. Based on clarifying the regulatory responsibilities of each department and fully discussing rectification plans, administrative public interest litigation lawsuits are issued to relevant units
