The Ministry of Justice has reviewed the filing of 2313 regulations and rules for the year 2022, including 1509 local regulations, 601 local government regulations, and 203 departmental regulations. After review, it has been preliminarily confirmed that 121 regulations and rules are inconsistent with the upper level law, and have been dealt with in accordance with legal authorities and procedures, effectively safeguarding the unity of the national legal system. It is reported that the issues identified in the review mainly reflect in reducing the scope of prohibitions under the upper level law, violating the Administrative Licensing Law, violating the Administrative Penalty Law, violating legal authorization, and other violations of the upper level law. The Ministry of Justice strictly implements the requirements of the Central Committee of the Communist Party of China that "there must be necessary documents, there must be preparations for review, and there must be corrections for errors", and has reviewed the reported regulations and rules one by one in accordance with the law. The issues discovered during the review were dealt with in accordance with the law. The official website of the Ministry of Justice regularly publishes the regulations and rules for filing, registration and review. Statistics show that from January to June 2023, the Ministry of Justice received 1368 regulations and rules submitted by local and departmental authorities to the State Council for filing. After review, 1340 registrations have been filed and 28 registrations have been postponed. The relevant person in charge of the Ministry of Justice said that strengthening the filing and review of laws and regulations is of great significance for promoting the improvement of the system of administration according to law, standardizing administrative power from the source, fundamentally promoting the full performance of functions of administrative organs according to law, and further promoting the comprehensive rule of law.
