On the occasion of World Environment Day on June 5th, the Supreme People's Procuratorate issued the "White Paper on Ecological Environment and Resource Protection Inspection (2018-2022)" (hereinafter referred to as the "White Paper"), summarizing the work situation over the past five years. The white paper points out that the number of arrests and prosecutions in cases of environmental resource protection crimes accepted and reviewed by procuratorial organs is generally on the rise. From 2018 to 2022, the national procuratorial organs accepted, reviewed, and arrested 65432 cases of crimes against environmental and resource protection, totaling 109848 people, an increase of 55.66% and 74.14% respectively compared to the previous five years; There were 209957 cases and 353223 cases of environmental and resource protection crimes that were reviewed and prosecuted, an increase of 112.75% and 92.66% respectively compared to the previous five years. The white paper shows that the crimes of disrupting environmental resource protection are relatively concentrated, mainly concentrated in six crimes: pollution of the environment, illegal fishing of aquatic products, illegal mining, illegal occupation of agricultural land, illegal hunting, and indiscriminate logging, accounting for 81.66% and 82.88% of the total number of cases and cases, respectively. The prosecution of ecological environment crimes by procuratorial organs has overall decreased, while the prosecution of resource protection crimes has overall increased. Among them, the crime of illegal fishing for aquatic products, the crime of illegal hunting, and the crime of endangering precious and endangered wildlife have seen the largest increase in animal resource related crimes. The white paper also summarizes that although the number of people suspected of the above-mentioned crimes accounts for the largest proportion, the non prosecution rate is the highest, indicating that the proportion of cases with minor or significantly minor criminal circumstances is relatively high in these types of cases. Zhang Xueqiao, Deputy Prosecutor General of the Supreme People's Procuratorate, introduced that in recent years, the Supreme People's Procuratorate has actively responded to the concerns of the people, strengthened investigation and research, and jointly with the Supreme People's Court, issued the "Interpretation on Several Issues Concerning the Application of Law in Criminal Cases of Destroying Wildlife Resources", clarifying the standards for conviction and sentencing of related crimes, and resolving major practical disputes such as the punishment rules for cases involving artificial breeding of wild animals, Better achieve compatibility between criminal responsibility and punishment. After the implementation of the explanation, the number of animal related cases has decreased by over 70%. It is worth noting that the white paper shows that from 2018 to 2022, cases of illegal disposal of imported solid waste and destructive mining crimes were sporadic, with only one digit per year, and there were no cases of unauthorized import of solid waste.
