On June 1st, the Supreme People's Procuratorate released the "White Paper on the Prosecutorial Work of Minors (2022)" (hereinafter referred to as the White Paper), which for the first time disclosed the strengthening of the integration and performance of the "four major procuratorates" by procuratorial organs, and the deepening of comprehensive judicial protection for minors. The white paper analyzes and summarizes the data related to the handling of cases involving minors in the "Four Major Prosecutors", strengthens two-way protection, strengthens integrated performance, promotes the overall implementation of the "Six Major Protections", promotes professional and standardized construction, and deepens theoretical research. According to the white paper, from 2020 to 2022, the procuratorial organs accepted the review, arrest, and prosecution of juvenile suspect, and juvenile delinquency showed an overall upward trend, with the proportion of young juvenile delinquency rising, the proportion of minors suspected of helping information network criminal activities rising significantly, the proportion of juvenile drug crimes continued to decline, and the number of campus bullying and violent crimes continued to decline, The rate of juvenile recidivism continues to decline. The white paper provides a statistical analysis of the implementation of special protection and special systems for minors: the legal aid system for minors has been effectively implemented. From 2020 to 2022, the number of people notified by the procuratorial organ to provide legal aid to minor suspect increased by 20.58% in the following year. At the same time, it is better to have the legal representative of minors and suitable adults present. The number of people who plead guilty and accept punishment leniency in juvenile delinquency cases has increased. From 2020 to 2022, the number of people who apply the leniency system of pleading guilty to juvenile delinquency cases by the procuratorial organ will be 50062, 61403 and 67097 respectively, and the number of people who apply the leniency system will increase year by year. The conditional non prosecution system for juvenile delinquency is well applied. From 2020 to 2022, there will be 11376, 19783 and 26161 underage suspect who are subject to conditional non prosecution by the procuratorial organ, and the application rate of conditional non prosecution will be 20.87%, 29.69% and 36.1% respectively. In 2022, 3.13% of the total number of people who were revoked and prosecuted without conditions accounted for 3.13%, which is basically the same as in previous years, reflecting the continuous improvement of the quality of applications while the number of applications increased. From 2020 to 2022, the procuratorial organs sealed criminal records of 28163, 31510, and 33021 eligible minors, an increase of 17.3% compared to 2020. The white paper also shows that the total number of crimes against juvenile delinquency has declined, but sexual assault cases are still on the rise, the number of crimes against public security management activities organized by minors has increased, and crimes against juvenile delinquency under the age of 14 have increased. According to the white paper, the procuratorial organs strictly crack down on various crimes that infringe on the rights and interests of minors, such as sexual assault and trafficking, in accordance with the law. The Supreme People's Procuratorate and relevant departments such as the Ministry of Public Security jointly launched a special action to combat sexual assault crimes and trafficking in women and children. Strictly arrest and prosecute crimes that seriously infringe on the rights and interests of minors, such as sexual assault and trafficking, and provide sentencing recommendations for heavier cases.
