Live streaming gambling hit the French internet

2023-05-25

Someone took advantage of the trend of live streaming sales to find hidden "business opportunities" and induced netizens to participate in online gambling by inserting advertising links in the live stream, leading to the illegal activity of "live streaming gambling". After being prosecuted by the Fenghua District Procuratorate of Ningbo City, Zhejiang Province, the court recently sentenced the defendant Xu to one year and ten months in prison, suspended for two years and six months, and fined 20000 yuan for the crime of aiding information network criminal activities. The court also made corresponding judgments on other defendants. In May 2022, netizen Xiao Hu watched a basketball game in a live broadcast room on a certain website. At first, the live broadcast host was still commenting on the game normally, but not long after, the "art style" changed. Suddenly, a scrolling subtitle advertisement titled "Download Chat App to Group" appeared on the screen. At this moment, the anchor began to provide detailed guidance to netizens on downloading and installing the app, and asked them to add the anchor as friends to participate in gambling together. Out of curiosity, Xiao Hu downloaded the app and added a host. The anchor immediately pulled Xiao Hu into a group, and a website link appeared in the group. Clicking on the link will enter a sports gambling website. The anchor told Xiao Hu that as long as you register an account and recharge on the website, you can participate in gambling. The money you win can be directly withdrawn by clicking on the website interface, and the money will automatically be credited to the bank card bound to the account. After playing for a while, Xiao Hu discovered that the website not only has gambling, but also other gameplay methods such as digital lottery, baccarat, and slot machines. Some people in the group recommend betting, and Xiao Hu occasionally follows and voluntarily bets. He has also played gambling and digital lottery. Xiao Hu also found that there are multiple anchors in the live broadcast room who take turns commenting on sports events, inserting advertisements in the middle of the commentary, allowing netizens to download chat apps to participate in gambling, and often using gimmicks such as "adding new members to groups and giving lottery money" to attract netizens to register and recharge. Later, Xiao Hu's family discovered the gambling website and promptly reminded him that it was illegal. Xiao Hu then reported the live broadcast room and website to the public security organs. In July 2022, Guo and other suspect were captured by the public security organs. According to Guo, from January to July 2022, he and several other anchors worked alongside the anchor nicknamed "Nana" to guide cross-border online gambling platforms while commenting on sports events in the live broadcast room. Their salaries were also paid by "Nana". A live broadcast of a football or basketball game can earn 150 yuan. During the live broadcast process, netizens can register a chat app account and annotate the host's nickname, and they can also receive a commission based on their head. Guo said that each time the settlement is made, he will send the payment code to "Nana", who will pay their salary based on the number of live games and the number of gambling influencers. After sorting out and checking Guo's WeChat and Alipay collection records, the public security organ found that Guo channeled more than 67000 yuan of illegal profits to the gambling platform through live broadcast, and many anchors in the live broadcast team were also channeling money to the gambling platform. After in-depth investigation, it was found that "Nana", also known as Xu, had opened a media live streaming store and had been in the broadcasting industry for five to six years. Her main income relied on netizens' tips and gifts, and her monthly income was not ideal. When she heard that her peers had made significant profits in attracting cross-border gambling platforms, she was moved. So, Xu contacted the live broadcast room group administrator,
