On the occasion of the promulgation of the Qinghai Tibet Plateau Ecological Protection Law of the People's Republic of China, in order to strengthen the promotion of the rule of law for ecological protection in the Qinghai Tibet Plateau and showcase the effectiveness of the people's court's judicial protection of the ecological environment in the snowy plateau, the Supreme People's Court released 10 typical cases of ecological protection in the Qinghai Tibet Plateau on May 5th. It is reported that on April 26th, the second meeting of the 14th National People's Congress Standing Committee passed the Qinghai Tibet Plateau Ecological Protection Law, which will come into effect on September 1, 2023. As another specialized law in the field of ecological and environmental protection in China, the Qinghai Tibet Plateau Ecological Protection Law closely follows the main line of ecological protection in the Qinghai Tibet Plateau, focusing on the main contradictions, special problems, and prominent characteristics of ecological protection in the Qinghai Tibet Plateau. It provides legal support for building a national ecological civilization highland and promoting sustainable economic and social development. The 10 typical cases of ecological protection in the Qinghai Tibet Plateau released this time include different types of litigation such as criminal, civil, administrative, and public interest litigation for environmental resources, covering ecosystem elements such as forests, alpine meadows, grasslands, rivers, lakes, wetlands, snow capped glaciers, etc., involving the protection of precious, endangered, and endemic wild animal and plant species in the Qinghai Tibet Plateau, the prevention and control of invasive species, the protection of major river sources and key lakes The protection of natural reserves such as national parks, prevention and control of mining pollution, ecological restoration, and protection of traditional ecological and cultural heritage are various aspects. Ten typical cases are: the criminal incidental civil public interest litigation case of three people, including Tang Mouliang, illegally fishing naked carp in Qinghai Lake; the criminal incidental civil public interest litigation case of a fire on the Forest steppe of the former Qilian Mountains; the case of six people, including Yang Mouping, illegally mining peat in Ruoergai Wetland; the case of five people, including Se Mou, stealing ancient cultural sites; the case of three people, including Se Mou, stealing cultural relics; the case of Wu Mou La and Xia Mou Bai endangering precious and endangered wildlife on the plateau, Eight people including Kangding Cement Co., Ltd., a village committee in Kangding City, Ganzi Tibetan Autonomous Prefecture, Sichuan Province, and Meng Mou'an engaged in illegal mining cases, an environmental research institute in Fengtai District, Beijing sued an aluminum industry limited company Lanzhou Branch for environmental pollution civil public interest litigation, and a dispute over solid waste pollution liability between a certain agricultural reclamation (group) Co., Ltd. in Qinghai Province and a certain development limited liability company in Golmud City, The People's Procuratorate of Longling County, Yunnan Province sued the People's Government of a certain town in Longling County for neglecting to fulfill the duties of intercepting, preventing, and controlling alien species in an administrative public interest lawsuit, while the People's Procuratorate of Langxian County, Tibet Autonomous Region sued a Natural Resources Bureau for neglecting to fulfill the duties of mine restoration and supervision in an administrative public interest lawsuit.
