Give play to the role of legal norms to protect the reputation of heroes

2022-12-13

The grass and trees are sad and the mountains and rivers are weeping. December 13 was the ninth national public memorial day for the victims of the Nanjing Massacre. In the ancient city of Nanjing, which was once devastated, in the white mountains and black waters where the blood and tears of our compatriots were soaked, in the Memorial Hall of the Chinese People's War of Resistance against Japanese Aggression and other anti Japanese war memorial sites, people from all over the country reviewed the painful history of the nation through various commemorative activities, remembered the martyrs of our compatriots, and prayed for peace. Don't forget the national humiliation and remember the heroes. In recent years, the social understanding of the history of the War of Resistance against Japan has become more profound, and the protection of heroes has become more and more perfect. In April 2018, the Law of the People's Republic of China on the Protection of Heroes and Martyrs was promulgated; The case of insulting the reputation of martyr Qiu Shaoyun, and the case of netizens' "hot pen ball" slandering and denigrating the heroes who protect the country and defend the border have strengthened the public's understanding of the protection of heroes. However, a recent investigation by the reporter of the Rule of Law Daily found that there are still some entertainment content of the War of Resistance against Japan spreading on the Internet, and some words related to the War of Resistance against Japan have been improperly used. Many interviewed experts pointed out that the above contents may dispel the sense of historical heaviness to some extent, which is not conducive to the guidance of positive values, and should arouse vigilance. We should protect the reputation and honor of heroes and martyrs by legal means, give full play to the normative and guiding role of the law, and provide institutional guarantee and legal force for the cultivation and implementation of socialist core values. Entertainment imitation frequently appears, "Those who know the current affairs are heroes, and all kinds of torture tools must be able to open your mouth..." Videos of Japanese soldiers interrogating anti Japanese soldiers using torture like this are widely disseminated on short video platforms. Many netizens imitated and interpreted the video content. The accent of the Japanese players and the tenacity of the anti Japanese performers became the focus. "Funny" and "Whole Life" were the overall comments of netizens on this kind of video. In some relevant short videos labeled "funny" and "anti Japanese", the aggressors are usually greedy and stupid. Netizens highlight their foolishness in the process of interpretation and are defeated by the flexible response of anti Japanese villagers. For such entertainment imitation, many interviewees believe that it is not conducive to the formation of correct historical cognition by the public. Zhao Ming, who was involved in the War of Resistance against Japan and the War to Resist US Aggression and Aid Korea, recalled to reporters that he and his comrades had a sudden encounter with the Japanese army. "The gunfire came like rain". At that time, he was lying on the ground, his thigh seemed to be hit by a brick. At first, he did not feel very painful. He struggled to return to the health team and found that the enemy's bullets went in from his left leg and out from his right leg. "At that time, the medical condition was very poor. The wound was infected and festered, but it did not improve for more than a month. Later, I had to bite my teeth and bear the pain to scrape off the fester with a knife." Remembering the blood and fire on the battlefield, Zhao Ming's eyes were moist. Zhao Ming didn't understand all kinds of online videos about that period of history. He thought that direct deduction without evaluation and entertainment imitation might distort that period of history. Lu Jingsheng, a professor of Renmin University of China, has made in-depth research on the issue of insulting and slandering heroes and martyrs. In his opinion, all kinds of entertainment videos are not worth advocating from the moral and ethical aspects. Moreover, playing specific characters in the video, such as Zhao Yiman and Yang Jingyu, may also involve legal issues. Military specialist
