Premier Li Keqiang recently signed a State Council order and promulgated the Regulations on Promoting the Development of Self employed Businesses (hereinafter referred to as the Regulations), which will come into force on November 1, 2022. Individual businesses are a large number of market players with Chinese characteristics, the "capillaries" of China's industrial chain supply chain and the "nerve endings" of the market, and the most direct service providers of the masses' lives. The Regulations adhere to and improve China's socialist basic economic system, adhere to the "two unswervingly", thoroughly implement the State Council's reform decision and deployment of "decentralization, management and service", adhere to the problem orientation, focus on playing the role of the government, focus on the outstanding difficulties facing the development of individual businesses, make targeted institutional arrangements, and promote the healthy development of individual businesses. The Regulation has 39 articles in total, including: First, it clarifies the status and role of individual businesses in the socialist market economy, as well as the basic principles for promoting the development of individual businesses. The individual economy is an important part of the socialist market economy, and individual businesses are important market players, playing an important role in prospering the economy, increasing employment, promoting entrepreneurship and innovation, and facilitating people's lives. The state has continued to deepen the reform of "decentralization, regulation and service", optimized the business environment, actively supported, strengthened guidance and standardized according to law, creating favorable conditions for the healthy development of individual businesses. The State applies the principle of equal market access and fair treatment to individual businesses. The property rights, operational autonomy and other legitimate rights and interests of individual businesses shall be protected by law, and no unit or individual may infringe upon or illegally interfere with them. Second, improve the working mechanism to promote the development of individual businesses. The State Council has established an inter ministerial joint conference system to promote the development of individual businesses. The market supervision and administration department under the State Council shall, together with relevant departments, strengthen the macro guidance, comprehensive coordination, supervision and inspection of the work of promoting the development of individual businesses. The relevant departments of the State Council shall study and formulate relevant policies and measures within their respective responsibilities. The local people's governments at or above the county level shall, in light of the development of individual businesses in their respective administrative areas, formulate specific measures and organize their implementation. The third is to clarify the responsibilities and requirements of the government and its relevant departments in promoting the development of individual businesses. The State strengthens the construction of the public service platform system for individual businesses. The government and its relevant departments provide support for self-employed businesses in terms of market entity registration, annual report services, business premises supply, capital, finance and taxation, finance, social security, entrepreneurship and employment, community convenience services, digital development, intellectual property protection, rescue and assistance, etc. Fourth, the government and its relevant departments should be strengthened to restrict the performance of their duties, and efforts should be made to protect the legitimate rights and interests of individual businesses. When formulating relevant policies and measures, the government and its relevant departments shall fully listen to the opinions of individual businesses and relevant industrial organizations, and shall not violate the regulations to formulate or implement discriminatory policies and measures against individual businesses in terms of qualification licensing, project application, government procurement, bidding and tendering. No unit or individual may, in violation of laws and regulations and the relevant provisions of the State, collect fees from self-employed businesses or charge fees in disguised forms, expand the scope of fees or raise the standards of fees without authorization, raise funds or apportion funds from self-employed businesses, or force self-employed businesses to provide sponsorship or receive paid services.
