Recently, the Procuratorate of Ningxia Hui Autonomous Region issued the Opinions on Further Strengthening the Intellectual Property Procuratorate (hereinafter referred to as the Opinions) to further promote the intellectual property procuratorate work, continue to increase the judicial protection of intellectual property, and better serve to ensure high-quality economic and social development. The Opinions clearly stated that the procuratorial organs at all levels in the region should further improve the system and mechanism of intellectual property procuratorial work, promote the implementation of centralized and unified performance of the procuratorial functions of intellectual property criminal, civil, administrative and public interest litigation, and build an integrated protection pattern of the whole chain of intellectual property procuratorial "arrest, prosecution, supervision, prevention and governance". Focus on the pain points, difficulties and obstacles of judicial protection of intellectual property rights, and strive to handle a number of typical cases with leading and exemplary significance. Actively integrate into the pattern of intellectual property protection, comprehensively improve the quality and efficiency of intellectual property prosecutorial work, and provide strong prosecutorial guarantee for the implementation of innovation driven development strategy and the cultivation of a legal business environment. The Opinions require strengthening internal and external cooperation and promoting the innovative development of intellectual property procuratorial work. We will improve the internal coordination mechanism and promote the normalization of cross departmental case consultation. Actively communicate with market supervision, courts, public security and other functional departments, improve the linkage mechanism between intellectual property administrative law enforcement and criminal justice, and unify the judicial standards for law enforcement. Strengthen the cooperation with the intellectual property management department, optimize the cooperation mechanism, and coordinate the implementation of the decisions and arrangements of the CPC Central Committee and the Party committees of autonomous regions on intellectual property protection. Establish and improve the communication mechanism with the Federation of Industry and Commerce, industry associations and lawyers associations, understand the difficulties and pain points of enterprise rights protection, and expand the source of clues. The Opinions emphasized that the high-quality development of intellectual property inspection should be enabled with the "big data inspection strategy", giving full play to the role of big data in widening the source of supervision clues, punishing crime prevention, supervising and correcting violations, protecting public interests and improving social governance. We will establish a mechanism for professional and technical personnel to assist in handling cases, establish and improve the expert consultation system for intellectual property prosecutorial cases, and the system for expert assistants to participate in handling cases. We will standardize expert consultation procedures, and achieve "external intelligence" through expert argumentation, case hearing, and other ways. (Outlook New Times)
