The reporter learned from the news conference of the Shanghai municipal government on the 16th that Shanghai will comprehensively implement no administrative punishment for minor illegal acts according to law, so as to reduce the economic burden of enterprises, reduce operating costs, provide clear guidance for grass-roots law enforcement, and improve law enforcement efficiency. The guiding opinions on comprehensively implementing no administrative punishment for minor illegal acts, which will be formally implemented in Shanghai on August 20, clearly stipulates that illegal acts that endanger national security, endanger people's lives, health or major property safety, and endanger the market economy or the basic order of social operation shall not be included in the list and shall not be punished. It is reported that the basis for not imposing administrative punishment for minor violations is the relevant provisions of the administrative punishment law. A relevant person in charge of the Shanghai Municipal Bureau of Justice said that minor violations are not subject to administrative punishment, which does not mean that any violation of the law by an enterprise can be tolerated, nor does it mean that law enforcement personnel can be exempted from punishment at will. No administrative punishment is only applicable to the illegal acts that comply with the statutory system of no administrative punishment, and a series of legal conditions such as timely correction and minor (or no) harmful consequences shall be met at the same time. It is reported that in 2019, Shanghai began to carry out the exploration of no administrative punishment for minor violations, with the original intention of solving the problem of "whether minor violations can not be punished and give enterprises a certain tolerance space". In the past three years, Shanghai has launched 14 lists, covering 10 fields such as market supervision, cultural market, transportation, water affairs, urban management, planning resources, ecological environment, civil defense, fire protection and meteorology.
