The disposal opinions of clues shall be put forward within 1 month from the date of receiving the clues. Clues to the disposal of problems shall be reported to the main person in charge of the post for examination and approval, and reported to the dispatched office for the record in accordance with the provisions. Article 38 If a post office needs to file a case for examination and investigation after preliminary verification, it shall be reported to the main person in charge of the post office for examination and approval. Among them, if the principal and Deputy leading cadres of the party organization directly led by the Party group (Party committee) and the leading group members managed by the Party group (Party committee) stationed in the unit are suspected of serious job violations and job-related crimes, they should be reported to the dispatched organ for examination and approval. If there are different opinions, it shall report to the dispatched office for decision. In case of special circumstances such as security and confidentiality, the principal of the Party group (Party committee) stationed in the unit may also be notified in time after the case is filed with the consent of the dispatched office. Article 39 after reporting for approval in accordance with regulations, the post office may take measures of conversation, interrogation, inquiry, retention, inquiry, freezing, search, retrieval, sealing up, seizure (temporary detention, sealing up), inspection and identification in accordance with regulations and disciplines. Article 40 after the review and investigation work is completed, the post office shall conduct the trial in accordance with the regulations, put forward suggestions on disciplinary treatment or Party discipline punishment, and the proposed administrative punishment decisions or punishment suggestions, and notify the Party group (Party committee) of the unit stationed. Article 41 the Party group (Party committee) stationed in the unit shall, in accordance with its authority and procedures, make decisions on disciplinary treatment or Party discipline punishment against Party organizations and Party members who violate discipline. The post office shall, in accordance with its administrative authority, make a decision on administrative sanctions against the illegal supervision objects according to law; If the resident unit is recommended to be punished, the resident unit shall make a punishment decision according to law and regulations. If the handling and punishment suggestions put forward by the post office are different from the opinions of the Party group (Party committee) of the unit stationed and cannot be reached through consultation, the post office shall report to the dispatched office for study and decision. Article 42 if the post office finds that the party organization and leading cadres managed by the Party group (Party committee) stationed in the unit have serious consequences or adverse effects due to dereliction of duty, which requires accountability investigation, it shall report to the main person in charge of the post office for approval, and then start the accountability investigation procedure. The post office shall carry out accountability investigation in accordance with the rules and disciplines, find out the problems of dereliction of duty and responsibility, make accountability decisions in accordance with the management authority, or put forward accountability suggestions to the Party Organization (unit) that has the right to make accountability decisions. If a party organization is held accountable by means of reorganization, it shall be implemented in accordance with the authority and procedures stipulated in the party constitution and other party regulations. If leading cadres are held accountable in the form of Party discipline and administrative sanctions, they shall be handled in accordance with Articles 38, 40 and 41 of these rules. Article 43 If the post office believes that the facts of the crime are clear, the evidence is reliable and sufficient, and criminal responsibility needs to be investigated after collective deliberation on the suspected job-related crimes of the monitored objects and the persons involved, it shall be transferred to the people's Procuratorate for examination and prosecution in accordance with the law and regulations.
