Photographed by Liu Haojun (people's vision) The six-month special action to crack down on pension fraud is being carried out in depth. Local public security and law enforcement units have quickly investigated, solved and tried a number of typical cases with great influence and high attention according to law. From providing "pension services" to investing in "pension projects", from selling "pension products" to declaring "pension by housing", from handling "pension insurance" to carrying out "pension assistance"... These cases have exposed fraud routines against the elderly group, which can be described as diverse and impossible to prevent, seriously infringing on the legitimate rights and interests of the elderly. This edition publishes four typical cases of fraud involving the elderly, focuses on common types of fraud, invites judges and prosecutors to disclose fraud tricks and means, carries out risk tips, and provides fraud prevention guidelines, so as to enhance the awareness and ability of the general public, especially the elderly, to prevent fraud. —— editor Induce "investment pension"—— Don't believe in "high return, low risk" Our reporter Qi Yukun [case] Mr. Cai forged his pseudonym Chen Wei and invented the fact that he had abundant funds. He set up a pension Industry Co., Ltd. and its affiliated companies in Hunan. Without the approval of the financial regulatory department according to law, he arranged employees to publicize in the name of developing pension apartment projects to attract investment, promised to provide for the elderly in other places, preferentially purchased the use right or property right of pension apartment beds, and refunded the principal and interest for three years. Some elderly people were confused by the "qualification materials" and "free travel" advertisements provided by Mr. Cai, the company's road signs and signs, and even the publicity of "relevant leaders visiting the company", and believed that they could pay for rooms and beds at ease. As of the time of the crime, Mr. Cai had illegally raised 79.4939 million yuan from 1442 unspecified objects. In addition to paying 37.1068 million yuan of the principal and return of the due investment of some customers, 42.3871 million yuan could not be returned. In addition, knowing that he had no actual ability to perform, Cai still signed a construction contract with Wang, defrauding Wang of a total of 3.5 million yuan of performance security. The court sentenced CAI to 18 years' imprisonment and a fine of 350000 yuan for several crimes of fund-raising fraud and contract fraud. In order to recover the losses of the fund-raising participants to the greatest extent, the procuratorial organs actively guide the investigation and evidence collection, carefully arrange the whereabouts of the funds involved, urge the public security organs to seal up, seize and freeze the relevant property, and strengthen the recovery of stolen goods and losses. [statement] Chen Huaying, prosecutor of the third procuratorial department of the Hunan Provincial People's Procuratorate, said that in recent years, some criminals have used the names of "investment pension" and "housing pension" and "high return and low risk" as bait to carry out false publicity, defraud people of pension money, and infringe on the legitimate rights and interests of the elderly. 1442 investors were cheated in this case, most of whom were elderly people. How to see through such scams? Chen Huaying suggested that first, always tighten the string of "investment is risky", do not believe in the so-called "win without loss", "risk-free, high-yield", and do not invest in projects with unclear business and unknown risks; Second, choose formal institutions and take formal channels. Before purchasing investment and wealth management products, consult more professionals of formal financial institutions and consult more with family members to understand and judge the authenticity and legitimacy of investment activities; Third, in the face of the pension project under construction, it is recommended to check whether the relevant procedures are complete; Fourth, pay attention to the protection of personal information, treat the contract signing process carefully, do not sign on blank contracts, and do not provide important information such as ID number, bank card number and password at will to prevent illegal use. Promote "elderly products"—— "Experts" set up a chain plan for selling drugs Our reporter Jin Xin [case] Ms. Wang Lan (a pseudonym) is old and suffers from diabetes. She is struggling to find an effective treatment. While browsing the web, she came across an advertisement "so and so Tang 'sugar melting formula' for the treatment of diabetes". Wang Lan called for advice, and the "expert" recommended the drug "Xiaoke oral liquid" to her. And said that if there is no curative effect, it will be refunded in full. After spending nearly 3000 yuan to buy "Xiaoke oral liquid", Wang Lan's condition did not improve, so she dialed the "expert" again. Whenever Wang Lan questioned the ineffectiveness of the drug, the other party recommended a new drug and persuaded Wang Lan that "all previous efforts will be wasted if you don't buy a new drug". Wang Lan bought the medicine more than ten times before and after, and spent tens of thousands of yuan. She didn't realize that she had been cheated until she was seriously ill after taking the medicine, so she called the police. After investigation by the public security organ, Zhu and others pretended to be doctors, fabricated the efficacy of drugs, contacted unspecified people by calling, wechat chat and other means, and defrauded many people of a total of more than 4.5 million yuan. Soon, Zhu and others were criminally detained by the public security organ. The procuratorial organ approved the arrest of suspect Zhu and others on suspicion of fraud and prosecuted them. [statement] Wang Dong, prosecutor of the Chaoyang District People's Procuratorate in Beijing, said that the case was a type of fraud in the name of selling "health products", "drugs" and other "elderly products". In this kind of fraud cases, criminals often cheat and induce the elderly group by pretending to be experts and carrying out false diagnosis and treatment. In this case, the lawbreakers exaggerated the efficacy of drugs, carried out false propaganda, and even set up a "serial plan", which made the victims deeper and deeper. Wang Dong suggested that the general public, especially the elderly, should be more careful when purchasing drugs and health care products: first, unlike formal free clinics, liars are often not in formal diagnosis and treatment places, but "consult" the elderly by telephone or "propaganda meetings". The elderly should be vigilant, do not easily believe all kinds of "expert" names, and should go to a regular hospital for treatment when they are unwell. Second, giving "free gifts" such as eggs and rice noodles and exaggerating "official background" are common routines for fraud against the elderly. Swindlers will also play the "family card" when introducing products, so that the elderly can put down their guard and be vigilant against such scripts and routines. Third, if you are found to be cheated, you should retain the evidence and call the police in time, which is conducive to the case handling organ to better handle the case and recover the losses in time. Cheat money in the name of marriage—— Beware of "Twilight love" as a scam Our reporter weizhezhe [case] Lin, an elderly man who has been alone for many years, was introduced to Huang. The two established a "lover" relationship in wechat chat. Huang borrowed money from Lin for lack of money to buy a house, and successfully defrauded 6000 yuan of "borrowing". "After I gave her the money for the first time, she signed a guarantee and promised to go through the marriage registration procedures with me. Later, she said to borrow money, and I agreed." Lin said. However, during their interaction, Huang did not use his real name and concealed the fact that he was married. In less than three months since he realized his contact, Huang repeatedly asked Lin for a total of 47000 yuan through fictitious facts such as buying a house and treating diseases. Later, Lin could not contact Huang. "Then I realized that I had been cheated!" After Lin called the police, Huang's family returned 47000 yuan. The court sentenced the defendant Huang to three years' imprisonment, suspended for three years and fined 10000 yuan for fraud. [statement] Ji Na, vice president of the third criminal division of the higher people's Court of Guangxi Zhuang Autonomous Region, said that concealing marital relationships, fabricating reasons for using money, and defrauding the elderly in the name of marriage and dating are a common way to defraud the elderly. In this kind of marriage and dating fraud, on the one hand, the victim has good expectations for love and gradually relaxes his vigilance; On the one hand, the fraudster takes money as the goal and carefully sets traps. The court analyzed the cases heard in recent years and concluded that the common routines of marriage and dating scams are mainly manifested as follows: first, fictitious identity, concealing marriage, pretending to be single, and even changing names in an attempt to get away at any time; Second, short-term contacts, excuses for money, false promises, take the opportunity to cheat money. The cheating party will also accelerate the realization of the purpose of asking for money by means of promising marriage and so on. Ji Na suggested that people should improve their awareness of fraud prevention when making friends in marriage and love. On the one hand, we should have an in-depth understanding of the other party's life, work, etc. when the other party proposes to lack money or borrow money, we should verify whether the money demand really exists and whether the demand amount is equivalent to the actual amount. If you agree to borrow money, you should also clarify the specific conditions such as the amount of the loan, the repayment period, and the agreed interest. On the other hand, in case of a short communication time and a need for money, we should be more cautious and try not to borrow or lend a large amount. If you frequently borrow money or repeatedly borrow money but fail to repay it, and the other party refuses to meet and loses contact, you should call the police in time to recover the loss. Advocate the appreciation of "collectibles"—— The "company" was originally a fraud gang Our reporter Ni Yi [case] Xu mouqiao registered and established a company and recruited employees to form a fraud criminal gang. These people package the cheap wholesale handicrafts, calligraphy and paintings as "collectibles" to lure the elderly who lack collection knowledge to buy. They lied that "collectibles" had a lot of room for appreciation. In order to dispel the concerns of the elderly, they also told the elderly that after the appreciation of collectibles, they could auction or sell them, and even buy back. In order to gain the trust of the elderly, Xu and others forged many "certificates". For example, false "collectibles" auctions, sales records, and even fabricated purchases of some "collectibles" can also enjoy financial subsidies. As of the crime, the fraud group has cheated more than 20.71 million yuan from more than 160 elderly people. The court sentenced Xu mouqiao to 14 years' imprisonment for fraud, and 16 other principals and accomplices were also sentenced. [statement] wuwenliang, a judge of the people's Court of Wujin District, Changzhou City, Jiangsu Province, said that in recent years, there have been a variety of fraud tactics against collectors, and the elderly group is prone to become a key target of fraudsters because of relatively few access to information and insufficient awareness of risk prevention. Criminals specially collect the contact information of the elderly, design marketing scripts for the elderly, take advantage of the psychological characteristics of the elderly who hope to make profits through the sale of collectibles and the weak awareness of fraud prevention, and use the bait of helping the elderly obtain high profits to deceive the trust of the elderly. Lawbreakers also use "collectibles companies" to package themselves, rent office space in prosperous areas for the "company", and have a relatively complete personnel structure and facilities, creating the illusion of normal operation of the "company" to cheat trust. Wu Wenliang suggested that when the majority of collectors, especially the elderly, invest in collections, they must carefully verify their qualifications and cannot simply judge whether they are formal by superficial phenomena such as the company's environment and scale. We should be alert to the crime of fraud and be alert to strange calls involving money. Don't trust the publicity or recommendation of criminals. We must trade through formal auction institutions. At the same time, we should strengthen our awareness of prevention and evidence, report to the police in time when we find signs of violations and crimes, and take effective measures to reduce losses
