According to the opinions of the Supreme People's Court on strengthening the trial of intellectual property in the new era and providing strong Judicial Services and protection for the construction of a powerful intellectual property country, the supreme law will issue judicial interpretations of anti-monopoly civil disputes and anti unfair competition, publish typical cases, give play to the role of "traffic lights", clarify judicial rules and standardize the behavior of market subjects. The opinions proposed to strengthen the judicial regulation of the monopoly of platform enterprises, severely punish the platform's forced "one out of two" and "big data killing" and other acts that undermine fair competition and disrupt market order, effectively protect the legitimate rights and interests of consumers and social public interests, and maintain and promote fair competition in the market. This opinion puts forward 20 policies and measures to comprehensively strengthen the trial of intellectual property rights in the new era from four aspects: work requirements, fair justice, improving efficiency and deepening reform. It is clearly proposed to apply punitive damages in accordance with the law, strengthen the compensation for damage caused by intellectual property infringement and the punishment for infringement, and timely and effectively curb infringement. Strengthen the regulation of false litigation and malicious litigation of intellectual property rights, prevent the abuse of intellectual property rights, and promote the construction of integrity system of intellectual property litigation. The Opinions also stressed that we should strengthen the construction of high-level intellectual property trial institutions and build a trial system with specialized trial, centralized jurisdiction and intensive procedures. Strengthen the construction of intellectual property trial team, and strive to forge an intellectual property trial team with political firmness, consideration of the overall situation, proficiency in law, familiarity with technology and international vision.
