Hubei Province issues the first national local regulation on the protection of martyrs

Recently, the 16th meeting of the Standing Committee of the 14th People's Congress of Hubei Province voted to pass the "Regulations on the Protection of Heroes and Martyrs in Hubei Province". This is the first local regulation in the field of hero and martyr protection in China, which will come into effect on July 1, 2025. There are currently 129000 registered martyrs in Hubei Province, ranking fifth in the country; There are 18 national level martyr memorial facilities, ranking third in the country; The number of provincial-level and county-level martyr memorial facilities, as well as other scattered martyr tombs, ranks among the top in the country. On May 1, 2018, the Law of the People's Republic of China on the Protection of Heroes and Martyrs came into effect. In recent years, Hubei has persisted in promoting the development of hero and martyr protection work, accumulating rich experience and practices. However, in practice, there are still problems such as inadequate protection of memorial facilities, insufficient promotion and innovation, and insufficient financial support. In September 2024, the draft regulation was first submitted for review at the 12th meeting of the Standing Committee of the 14th People's Congress of Hubei Province. On March 26, 2025, the regulation was voted and passed. The regulations consist of 7 chapters and 45 articles, mainly providing provisions in five aspects: commemoration and commemoration, protection and management of memorial facilities, promotion of deeds and spirits, compensation and preferential treatment for survivors, and legal responsibilities. The regulations fully protect the image of heroes and martyrs and the environment and atmosphere of memorial sites, and explicitly prohibit setting up stalls and engaging in commercial activities without authorization; Prohibit the use of high-power audio equipment and other entertainment and fitness activities that disrupt the solemn, dignified, and clean environment and atmosphere; Without consent, it is prohibited to engage in activities such as exhibitions, performances, and film and television shooting. The regulation clearly prohibits distorting, vilifying, desecrating, and denying the deeds and spirit of heroes and martyrs. If the information platform discovers behavior that insults martyrs, it should immediately handle it, prevent the spread of information, keep records, and report to relevant departments; If not handled, it will be punished in accordance with the Cybersecurity Law of the People's Republic of China. The procuratorial organs may initiate public interest litigation in accordance with the law against acts that infringe upon the names, portraits, reputations, and honors of heroes and martyrs, and harm the public interest of society. The regulations also stipulate that when transporting or burying the ashes or remains of heroes and martyrs, the people's governments at or above the county level shall hold solemn, dignified, civilized, and frugal welcoming and burial ceremonies; The relevant departments should provide convenience for the families of heroes and martyrs to pay their respects, confirm the identity of unknown martyrs, search for relatives, implement coding and digital management of scattered hero and martyr memorial facilities, and include martyr interpreters in hero and martyr memorial facilities such as martyr cemeteries in the scope of professional and technical title evaluation such as cultural relics museums.
