How to better implement the new policy of controlling the disorderly installation and use of cameras

2025-04-03

The Regulations on the Management of Public Safety Video Image Information Systems (hereinafter referred to as the "Regulations") will officially come into effect on April 1st. How can relevant norms and regulations be better implemented and enforced? How to better protect personal information while meeting public safety needs? Reporter connects with Wang Lei, a researcher at the Intelligent Technology Law Research Center of Beijing Institute of Technology, to provide analysis and interpretation. Which public areas can be equipped with cameras? This regulation strictly limits the installation purpose of cameras and eliminates unnecessary image capture devices; It also strictly limits the construction subject, avoiding unrelated personnel and units from installing as they wish. In terms of the installation of public safety video and image systems, four categories have been identified: gathering places for people, transportation hubs, large and medium-sized public transportation vehicles, service areas of highways and ordinary national and provincial trunk lines, and subdivided scenes such as common commercial centers, tourist attractions, medical institutions, parks, railway bus stations, etc. What is the specificity of the Regulation? Wang Lei, a researcher at the Intelligent Technology Law Research Center of Beijing Institute of Technology: The application of the Regulation has established a very good rule for the collection of images and image information systems in the public domain. Whoever builds, takes responsibility. Some fields and places actually have public safety attributes. At the same time, during the filming process, there may be some privacy related to facial and personal information. Therefore, the "Regulations" have raised the supervision of pre -, during -, and post engagement to the source, and have implemented governance and regulation during the construction phase. At the same time, the Regulation clarifies that public safety video and image systems cannot be installed by anyone who wants to, and the installation process must meet the conditions for filing. For situations where we no longer comply with relevant regulations, we can actually impose some penalties, such as confiscating equipment. When installing cameras in public areas, it is necessary to inform the public that according to the regulations, the place where cameras are installed must inform the public that there is surveillance here. If no prominent warning signs are set up, the public security organs shall order correction. Wang Lei, a researcher at the Intelligent Technology Law Research Center of Beijing Institute of Technology: If there are video capture systems in the field of public safety that have not been registered or have not been marked with relevant signs, they can report the situation to the public security organs and request them to rectify it. Those who refuse to rectify shall be subject to corresponding punishment measures. If it involves illegal filming or other behaviors that may constitute criminal offenses, there will be criminal laws to regulate it. Source control of illegal filming, with public safety attributes as a prerequisite. For the problem of illegal filming in hotels and homestays, in the past, only those who engaged in illegal filming could be punished. Now, according to the regulations, as long as they are installed, they can be punished. Wang Lei, a researcher at the Intelligent Technology Law Research Center of Beijing Institute of Technology: In some privacy fields or fields with stronger privacy attributes, it is not allowed to install cameras. The Regulation is actually balancing the interests of public safety and private attributes. How to balance public safety attributes is a prerequisite and a key focus of regulation. What are the difficulties in preventing cameras from leaking personal information? Wang Lei, a researcher at the Intelligent Technology Law Research Center of Beijing Institute of Technology: The management of cameras involves multiple parties, such as the participation of power agencies, and some places may be personal. To ensure both public safety and personal information rights, we need to implement a series of systems to ensure the implementation of the Regulations, such as who has relevant permissions, whether there is a registration system for relevant calls, the duration of video storage, and some management functions involved. Through these aspects, we can achieve effective management of videos. How to ensure that the Regulations can come into effect? Wang Lei, a researcher at the Intelligent Technology Law Research Center of Beijing Institute of Technology: I think the Regulations have a good start. For situations such as facial information and audio and video, our awareness of personal information rights is actually constantly strengthening. After discovering illegal and irregular situations, social forces and personal information subjects should also actively provide feedback. (New Society)
