Supreme People's Court: Implement systems such as grace periods for dishonesty punishment and one-time lifting of restrictions

2025-03-11

On the 10th, the Supreme People's Court held the third event of a series of all media live interviews to interpret the "Work Report of the Supreme People's Court" for the 2025 National People's Congress and Chinese People's Political Consultative Conference. Huang Wenjun, Director of the Enforcement Bureau of the Supreme People's Court, introduced that in recent years, the people's courts have implemented a graded classification, grace period, and single unlocking mechanism for dishonesty punishment, making the enforcement work warm, rhythmic, and emotional. Adhere to the principle of grading and classification, and give different disciplinary periods to the debtor according to the severity of their dishonest behavior. If the debtor actively fulfills the obligations determined by effective legal documents or actively corrects their dishonest behavior, the people's court may delete the dishonest information in advance and promptly help the debtor repair their credit. Implement systems such as grace periods for punishment of dishonesty and one-time lifting of restrictions. For those who are intended to be included in the dishonesty list, the consequences of being included in the dishonesty list shall be fully explained to them, and a grace period of one to three months shall be given based on the case. Fully consider the special circumstances in reality where dishonest individuals have a need to travel by plane or high-speed rail. If the person subject to execution who has been included in the list of dishonest persons urgently needs to travel to another place due to major illnesses, funerals of close relatives, or the execution of official duties, the restriction shall be temporarily lifted. Adhering to the equal emphasis on punishing dishonesty and rewarding integrity, in practice, some executed persons, although facing temporary business difficulties, still actively fulfill their obligations and demonstrate good qualities of honesty and trustworthiness. The people's court has helped "honest but unfortunate" executed persons regain a new life through goodwill and civilized execution measures such as "live sealing and detention". (New Society)
