Properly utilizing the fallback provisions, principle clauses, and legal purpose clauses of the Anti Unfair Competition Law, with the principles of good faith and business ethics as the basic standards, effectively curbing various new types of unfair competition behaviors that imitate and hinder innovation, and providing judicial norms and guidance for the formation of a fair and honest competition order. Opinions on strengthening the judicial protection of scientific and technological innovation entities in accordance with the law, mainly clarifying the rules of judgment from five aspects: determining the ownership of scientific and technological achievements, adjudicating technical contract disputes, optimizing the operation mechanism of innovation entities, and protecting the normal and reasonable flow and performance of scientific and technological personnel. Infringement behavior disrupts the market order of fair competition and affects the social environment for innovation.
