According to the website of the Supreme People's Court, the Supreme People's Court and the China Council for the Promotion of International Trade jointly issued the "Notice on Establishing an Online Litigation and Mediation Mechanism for Commercial Disputes" (hereinafter referred to as the "Notice"), which puts forward clear requirements for establishing and improving the mechanism for preventing and resolving commercial disputes. The Notice requires that we should actively integrate into the social governance system of co construction, co governance, and sharing under the leadership of the Party Committee, establish and improve a diversified mechanism for resolving commercial disputes, fully leverage the unique advantages of the "general to general" mechanism in preventing and resolving commercial disputes, and promote the prevention and resolution of more sources of commercial disputes. The Notice points out that the Supreme People's Court relies on the mediation platform of the People's Court, and the China Council for the Promotion of International Trade relies on the online mediation platform of the China Council for the Promotion of International Trade Mediation Center to facilitate online and offline mediation and litigation channels, providing parties with full process online dispute resolution services such as entrusted mediation, video mediation, mediation agreement production, application for judicial confirmation of mediation agreements, and application for mediation documents. The Notice stipulates the specific work content of the online litigation and mediation docking mechanism for commercial disputes, including division of responsibilities, workflow, and construction of mediation teams, and puts forward specific requirements for the selection, management, training, guidance, and other work of mediation organizations and mediators. The Notice emphasizes the need to integrate the leadership of the Party throughout the process of diversified resolution of contradictions and disputes, and promote the formation of a diversified resolution work pattern under the leadership of the Party, which involves internal and external linkage, top-down coordination, and orderly connection. Strengthen communication and consultation, promote the establishment of work coordination and information sharing mechanisms in various regions.
