Private car forcing ambulance to retreat? 'Giving way for life' requires the protection of the rule of law
2024-12-13
According to a report by CCTV News on December 9th, at around 7:00 am on December 6th, an ambulance encountered a temporary obstruction on the internal road of a residential area in Dachang Hui Autonomous County, Hebei Province, when it encountered a resident vehicle traveling in the opposite direction. From the live video online, it can be seen that two cars are driving towards each other, with the ambulance retreating and the private car moving forward, and there is considerable space behind and to the left and right of the private car. Such abnormal operation has sparked heated discussions, with netizens accusing the private car involved of being too domineering. Recently, the local public security bureau issued a notice stating that it had intervened in the investigation as soon as possible and imposed administrative detention on the illegal car owner in accordance with China's Public Security Administration Punishment Law. When encountering special vehicles such as ambulances, fire trucks, and police cars with lights on and sirens on the road, the public almost has the awareness and consensus to give way. This is not only a driving common sense that drivers should remember and practice, but also a basic requirement of the law. According to China's Road Traffic Safety Law, when performing emergency tasks, ambulances may not be restricted by their driving route, direction, speed, or traffic lights, while ensuring safety. Other vehicles and pedestrians should give way. In this legal provision, the word "should" clearly expresses that yielding is a "must" and an obligation. The Law on Public Security Administration Punishments clarifies the punishment standards, and those who obstruct the passage of fire trucks, ambulances, engineering rescue vehicles, police cars and other vehicles carrying out emergency tasks shall be given a warning or fined up to 200 yuan; If the circumstances are serious, the offender shall be detained for not less than five days but not more than ten days and may be fined not more than 500 yuan. In reality, when faced with special vehicles carrying out tasks, most drivers will actively cooperate and give way. For example, we often see heartwarming videos like this: some residential areas catch fire, and pedestrians on the road are clearing and leading the way for fire trucks; Some ambulances encounter traffic congestion, and private cars are giving way to both sides at a 45 degree angle. There may be a few situations where drivers do not give way, and they may have their reasons, such as at intersections with traffic signals where drivers are worried about being punished or appealing to relevant departments to revoke the punishment, and therefore do not give way. In fact, it is not cumbersome to appeal for revocation of fines, points, and other penalties caused by giving way. For example, there are many typical examples of taxi drivers running red lights while escorting patients for medical treatment, not only without being fined, but also receiving praise. When special vehicles such as police cars, fire trucks, ambulances, and engineering rescue vehicles perform emergency tasks, they often directly affect public safety and public interests, including life-threatening emergencies. Therefore, they are racing against time and cannot be delayed for a moment. Allowing special vehicles to travel smoothly requires not only consensus among people, but also the protection of the rule of law. Only by punishing those who violate the law can we awaken more people's awareness, gather broader consensus, and safeguard public safety. Therefore, relevant departments should not only strictly enforce the law, but also strengthen the publicity and warning of related cases. Taking the incident in the news as an example, the ambulance was obstructed, causing the patient to delay seeking medical treatment and ultimately resulting in death. A lawyer has stated that if medical evidence shows that refusal to give way is related to delayed treatment and the patient's death outcome, the car owner will be held liable for civil compensation. Such legal consequences are a warning to every driver and should be kept in mind. (New Society)
