According to the news on December 6 of the WeChat official account "Guangzhou People's Congress", the Regulations on the Administration of Electric Bicycles in Guangzhou (hereinafter referred to as the Regulations), adopted at the 31st meeting of the Standing Committee of the 16th People's Congress of Guangzhou on September 27, 2024, was approved at the 13th meeting of the Standing Committee of the 14th People's Congress of Guangdong Province on November 28, 2024, and is hereby promulgated and will come into force as of December 30, 2024. The Regulation consists of 8 chapters and 55 articles, providing comprehensive regulations on the management of electric bicycle production, sales, maintenance, registration, passage, parking, charging, and other aspects. It also specifies the responsibilities of relevant government departments, as well as the obligations and responsibilities of electric bicycle operators, food delivery companies, and other enterprises. The Regulations stipulate that when driving on non motorized vehicle lanes with a maximum speed exceeding 15 kilometers per hour, it is prohibited to use communication tools, browse electronic devices, smoke, eat, and other behaviors that hinder safe driving in a handheld manner; Electric bicycles are prohibited from driving on highways, urban expressways, inner ring roads and their radiating areas, river tunnels, sidewalks, shoulders, bridges, tunnels, elevated roads, overpasses, and other prohibited roads without independent non motorized vehicle lanes. The municipal and district governments may make regulations on roads that restrict or prohibit the passage of electric bicycles in accordance with the law. The traffic management department of the public security organs shall notify the owners of electric bicycles to accept investigation and handling within the prescribed time limit for road traffic violations recorded through traffic technology monitoring; If the owner of an electric bicycle entrusts someone else to drive it, they shall inform the driver to accept investigation and handling. The traffic management department of the public security organs may use speed measuring devices and other equipment that comply with regulations to collect and fix evidence of road traffic violations such as electric bicycles speeding. If an electric bicycle has three or more records of road traffic violations and the owner or driver refuses to accept the handling after being notified by the traffic management department of the public security organ in accordance with the law, the traffic management department of the public security organ may detain the vehicle. For riders who have committed serious traffic violations such as running red lights, speeding, and driving in the opposite direction three or more times within a week, the company shall implement single control measures. If the property service provider fails to dissuade or stop the parking and charging of electric bicycles that violate fire safety management regulations, or fails to report in a timely manner, the fire rescue agency or the housing and urban-rural development department shall, in accordance with their authority, order them to make corrections within a specified period of time. If the property service provider is a unit and fails to make corrections within the prescribed time, a fine of not less than 5000 yuan but not more than 20000 yuan shall be imposed. If the circumstances are serious, a fine of not less than 20000 yuan but not more than 50000 yuan shall be imposed; If the property service personnel are individuals, they shall be given a warning or fined up to 500 yuan. The Regulation also specifies that the Municipal People's Government may implement total quantity control on electric bicycles based on the development status and direction of urban road traffic, taking into account reasonable transportation needs. At the same time, administrative departments such as transportation and public security traffic management should combine the characteristics of electric bicycle traffic, set up non motorized vehicle lanes and improve traffic facilities such as non motorized vehicle signal lights and signs and markings on roads where conditions permit. When constructing or expanding roads, the construction unit shall set up non motorized vehicle lanes in accordance with relevant regulations. According to previous media reports, as of September 2024, the number of registered electric bicycles in Guangzhou was 5.4 million, and it is still growing at a rate of about 4000 per day and about 100000 per month. With the rapid increase in the number of electric bicycles, the illegal and disorderly behavior of electric bicycles has become increasingly prominent, endangering the safety of people's lives and property, and affecting the orderly operation of cities. According to relevant data, since 2022, the Guangzhou Public Security Traffic Police Department has investigated and dealt with over one million cases of electric bicycle traffic violations every year. Since 2023, there have been over 1500 traffic accidents caused by electric bicycles speeding, resulting in hundreds of injuries and dozens of deaths. 60% to 80% of trauma orthopedic patients in major hospitals are caused by traffic accidents such as electric bicycles speeding.
