14 measures to serve and safeguard the migrant worker population

Recently, in order to further improve the service and guarantee work for migrant workers, the Ministry of Human Resources and Social Security, together with 10 departments including the National Development and Reform Commission and the Ministry of Education, issued the "Opinions on Further Strengthening the Service and Guarantee Work for Migrant Workers" (hereinafter referred to as the "Opinions"), focusing on key content related to migrant workers' work such as ensuring and improving people's livelihoods, promoting urban-rural integration development, and addressing key and difficult issues such as employment income increase, human resources development, employment assistance for older migrant workers, rural revitalization, protection of rights and interests in new forms of employment, expansion of insurance coverage, and basic public service supply in permanent residence. Fourteen measures were proposed to promote stable employment for migrant workers, safeguard labor security rights and interests, and strengthen public service supply. Employment is the most basic livelihood. In 2023, the total number of migrant workers in China will be 298 million, including 177 million migrant workers who have left their hometowns. According to the relevant person in charge of the Ministry of Human Resources and Social Security, in order to stabilize and expand the employment of migrant workers, the overall growth rate of the migrant worker population has slowed down, the aging level has continued to deepen, the employment radius has continued to shrink, and the forms of employment have become diversified. Structural contradictions remain prominent. The Opinion proposes to adhere to the principle of giving equal importance to both outbound and local employment, and to take multiple measures to broaden the employment channels for migrant workers; Optimize policies on venues, finance, taxation, etc., and support migrant workers to return home and start businesses; Carry out targeted vocational skills training and implement subsidy policies related to training to enhance the skills and qualities of migrant workers; Establish a long-term mechanism for employment assistance and stabilize the employment of poverty-stricken populations. At present, there are nearly 13 million people returning to their hometowns and starting businesses nationwide, and the human resources and social security departments support more than 2200 entrepreneurial parks and bases mainly targeting migrant workers. To further support migrant workers to return home and start businesses, the Opinion proposes to create a number of entrepreneurship parks and strengthen the construction of entrepreneurship carriers for returning home; Implement various preferential policies such as entrepreneurship subsidies, guaranteed loan interest subsidies, and tax reductions, develop entrepreneurship insurance products, optimize financial service supply, and effectively solve the funding problems faced by migrant workers returning home to start businesses; Organize activities such as migrant worker entrepreneurship competitions to cultivate more innovative and entrepreneurial talents. By 2023, 97% of urban areas with a permanent population of less than 3 million will have their household registration restrictions completely lifted. 96.7% of migrant workers' accompanying children will attend public schools or enjoy government purchased degrees, and over 5 million stable employment migrant workers in urban areas will enjoy public rental housing guarantees. In order to promote equal access to basic urban public services for migrant workers and promote their urbanization, the Opinion proposes to optimize the scoring criteria for point based household registration, carry out new citizen training, and encourage willing migrant workers to settle in urban areas; Optimize the allocation of regional educational resources and expand the supply of public school places; Gradually include the stable employment and livelihood of migrant workers in the scope of urban housing security policies; Promote the integration of basic public services between urban and rural areas, and implement the action to improve the quality of urbanization of rural migrant workers in counties. At present, there are still shortcomings and weaknesses in the protection of the rights and interests of migrant workers. In order to safeguard the labor protection rights and interests of migrant workers, the "Opinions" propose to urge enterprises to comply with labor contracts, protect the rights and interests of new forms of employment workers, and standardize enterprise employment management; Improve the long-term mechanism for eradicating wage arrears, strengthen the construction of expedited arbitration courts for wage disputes among migrant workers, and establish a "green channel" for legal aid for migrant workers; Establish a sound social security system for migrant workers, flexible employees, and new forms of employment, and promote their participation in social insurance such as pension, medical, unemployment, and work-related injuries.
