The Supreme People's Court releases typical cases of traffic accident liability disputes

Today (December 2nd) is National Traffic Safety Day, and the Supreme People's Court has released five typical cases of traffic accident liability disputes, involving the responsibility of vehicles that have not legally purchased compulsory traffic insurance for traffic accidents; Determination of compensation liability for accidents involving non motor vehicles in reverse and motor vehicles; Distribution of losses in accidents caused by free riding. Traffic accidents often cause personal and property damage, and even result in serious consequences such as disability and death, leading to the victim's life being trapped in hardship. Timely and sufficient protection and relief for the infringed are the primary concerns of the court in the trial of traffic accident liability disputes. The reporter noticed that in Case 2, the People's Court supported the compensation request for lost wages of the infringed party who exceeded the statutory retirement age but still relied on labor to obtain income, reflecting the comprehensive protection of the infringed party. With the development of transportation and the improvement of people's quality of life, the number of motor vehicles and non motor vehicles, as well as the mileage of roads, are rapidly increasing. The number of traffic participants is also growing, and disputes over traffic accident liability are prone to occur. In Case 1, the People's Court ordered the policyholder who did not legally purchase compulsory traffic insurance to jointly bear the compensation liability with the traffic accident infringer within the liability limit of compulsory traffic insurance, and promptly safeguard the rights and interests of the infringed party. This case also reminds car owners to legally purchase compulsory traffic insurance to provide the most basic protection for themselves and other transportation participants. After a traffic accident occurs, obtaining compensation for damages as soon as possible, reducing the cost of rights protection, and avoiding increasing the burden and cost of dispute resolution are usually the "urgent and difficult worries" of the masses. The people's court focuses on exploring experience in individual cases, improving and perfecting diverse dispute resolution mechanisms, and striving to build convenient channels for the masses to safeguard their rights. In Case 5, the People's Court, based on the facts of the case and the litigation behavior of the parties, keenly realized that the appeal of a certain insurance company was not for the purpose of safeguarding rights, but based on performance evaluation considerations. Therefore, it increased its mediation efforts, actively persuaded the insurance company, and put forward opinions and suggestions on issues such as performance evaluation behind the litigation. The company voluntarily withdrew its appeal and immediately paid compensation, allowing for a convenient and effective resolution of the dispute. (New Society)
