A man named Hu maliciously used the e-commerce platform's "no reason to return goods within the deadline" rule to defraud more than 2.27 million yuan in payment by "buying genuine goods and returning fake ones". Recently, the Chaoyang District People's Court in Beijing held a public hearing in accordance with the law to hear this case. The defendant Hu was convicted of fraud and sentenced to 11 years in prison, deprived of political rights for 2 years, and fined 110000 yuan. The case shows that within a year and a half, Hu purchased bags, cameras, graphics cards and other goods multiple times on an e-commerce platform. Later, he fabricated the reason for return and applied for a "return and refund" online, and sent low-priced items that did not match the purchased goods to the e-commerce platform offline, deceiving the victim unit into refunding him a total of 2.27 million yuan. Later, Hu sold the unreturned genuine products through a second-hand platform. The court believes that the defendant Hu fraudulently obtained property from others with the purpose of illegal possession, and the amount involved was particularly large. His behavior has constituted the crime of fraud. Considering that Hu's family has compensated for some of the economic losses on behalf of him and there are assets available for compensation, the court has imposed a lenient punishment on him. After the first instance judgment was made, the defendant did not appeal and the judgment has taken effect. The judge reminds that online e-commerce provides a service of returning goods without reason within a certain period of time. Consumers should follow the principle of honesty and credit, and fulfill their obligation to return goods truthfully and in good condition.
