Artificial intelligence is a strategic technology leading the future, an important driving force of the new round of scientific and technological revolution and industrial change, and a scientific and technological high point that must be seized. In the new era, the Party Central Committee with Comrade Xi Jinping as the core attaches great importance to the development of artificial intelligence, and actively promotes the deep integration of the Internet, big data, artificial intelligence and the real economy. Adapt to the needs of reality. In the new era, China has formulated laws such as the network security law, the data security law, the personal information protection law and other laws, which, to a certain extent, have already involved the safety regulation of artificial intelligence. In addition, the relevant departments have also issued departmental regulations such as the Administrative Provisions on Algorithmic Recommendation of Internet Information Services and the Administrative Provisions on Depth Synthesis of Internet Information Services, which have played a positive role in the governance of artificial intelligence. However, compared with the growing demand for the rule of law in AI safety regulation, there are still some shortcomings and deficiencies in the relevant norms. For example, the legal system is not perfect enough, there is a lack of specialized laws on AI safety regulation, and there are still legislative gaps on some key issues of promoting development and ensuring safety; the existing rules are scattered in numerous laws and departmental regulations, and some rules are insufficiently coordinated and articulated with each other; and so on. To promote the rule of law in AI governance, it is necessary to deeply promote scientific legislation, democratic legislation and legislation in accordance with the law, summarize the experience of AI governance, bring together the strength and wisdom of all parties to accelerate the legislative process of AI, and ensure that AI is always moving in the direction of continuously enhancing the well-being of the people.
Establish the basis for governance. With the vigorous development of a new generation of AI technologies such as generative AI, AI products and services are becoming increasingly commercialized, mass-marketed and popularized, the potential security risks of AI have subsequently become more prominent, and the people's demand for ensuring that AI is safe, reliable and controllable has become even stronger. To accelerate the legislative process of AI and promote the rule of law in AI governance, it is necessary to adhere to Xi Jinping's thought on the rule of law as a guide, adhere to the people-centered development ideology, provide a more complete legal basis for the safe regulation of AI, and create a good rule of law environment conducive to the healthy development of AI. It is necessary to clarify the concepts and basic legal principles that should be followed in the research and development, use, and governance of AI technology, establish the correct value orientation of AI governance, and provide value guidance for the interpretation and application of AI legislation as well as for its improvement and development. It is necessary to establish the basic legal rules of AI governance, help break down institutional barriers to the development of AI, provide a legal basis for the formulation of AI governance rules and regulations and other subordinate laws, and provide authoritative guidelines for AI safety supervision, law enforcement and judicial activities, and promote the implementation of the Global Initiative on Artificial Intelligence Governance.
Utilize institutional efficacy. Accelerating the legislative process of AI and promoting the rule of law in AI governance aims to promote the healthy development of AI. Rules should be improved in terms of technology research and development, data utilization, arithmetic supply, incentives for innovation, and technology sharing to better meet the institutional needs of AI industry development and the deep integration of AI with economic and social development. AI legislation should coordinate development and safety, focus on resolutely maintaining national security and social stability, improve safety regulation rules, strengthen hierarchical and classified supervision, enhance dynamic analysis, assessment and early warning of relevant risks, and improve the ability to regulate AI safety.
