In order to fully implement the spirit of the Third Plenary Session of the 20th Central Committee of the Communist Party of China, further regulate the charging behavior of industry associations and chambers of commerce, guide industry associations and chambers of commerce to carry out activities, provide services and charge fees in accordance with the law and regulations, the State Administration for Market Regulation, together with the Central Ministry of Social Work and the Ministry of Civil Affairs, recently jointly issued the "Compliance Guidelines for Charging Behavior of Industry Associations and Chambers of Commerce" (hereinafter referred to as the "Guidelines"). The Central Committee of the Communist Party of China and the State Council attach great importance to the standardized and healthy development of industry associations and chambers of commerce. Industry associations and chambers of commerce undertake important responsibilities such as serving the development of enterprises, reflecting industry demands, resolving conflicts and disputes, and strengthening industry self-discipline. They are the bridge and link between the government, enterprises, and the market. The Guidelines thoroughly implement the spirit of the Third Plenary Session of the 20th Central Committee of the Communist Party of China, implement the decision-making arrangements of the Party Central Committee and the State Council on further optimizing the business environment and resolutely rectifying arbitrary fees, summarize and standardize the regulatory practices of industry associations and chambers of commerce in terms of fees, adhere to preventing industry diseases and encouraging innovative development, adhere to problem oriented and goal oriented approaches, adhere to reasonable classification and comprehensive measures, and use a "comparable, operable, and predictable" approach to clarify specific requirements, handling methods, and consequences of illegal and irregular activities. It aims to guide industry associations and chambers of commerce to develop in a standardized and healthy manner, safeguard the legitimate rights and interests of industry associations and chambers of commerce and other business entities, and better play the positive role of industry associations and chambers of commerce in the market economy. The "Guidelines" consist of 7 chapters, including General Provisions, Membership Fees, Administrative Fees, Business Service Fees, Other Fees, Violation Handling, and Supplementary Provisions, totaling 54 articles. The "General Provisions" section clarifies the drafting purpose, scope of application, types of fees, basic principles, and basic requirements; The "Membership Fees" section provides a detailed overview of the requirements for establishing membership fee standards, managing receipts, prohibiting mandatory membership, and prohibiting multiple fees; The three parts of "administrative fees", "business service fees", and "other fees" provide clear requirements for administrative fees, business service fees, and other types of fees, including bill management, government commissioned matters, mandatory training, professional qualification examinations, and other aspects; The "Violation Handling" section clearly points out various illegal and irregular charging behaviors and corresponding handling methods; The "Supplementary Provisions" section clarifies the applicable subjects and guiding principles of the "Guidelines". The three departments stated that the release of the "Guidelines" is an important step in establishing a long-term mechanism for the supervision of fees by industry associations and chambers of commerce, as well as the first step in the construction of a fee supervision system for enterprises. It will effectively promote the standardization of fee behavior by industry associations and chambers of commerce, and encourage them to play a more active role in economic and social development. At the same time, it also provides regulatory authorities with clearer and more specific regulatory basis, which helps to consolidate law enforcement effectiveness and enhance regulatory efficiency.
