The latest data revealed at the meeting shows that high-value intellectual property rights continue to emerge in China, effectively empowering economic innovation and development. Vigorously promoting patent transfer and transformation has been a major focus of intellectual property work in recent years. Shen Changyu, Director of the China National Intellectual Property Administration, said that since the issuance of the Special Action Plan for Patent Transformation and Application (2023-2025), the China National Intellectual Property Administration has closely cooperated with various departments and regions, formulated and issued relevant supporting policies, and taken a number of measures to effectively solve the problem of patent transformation. First, it has accelerated the inventory of existing patents in universities and scientific research institutions. "We have built a data platform for the inventory of invention patents of universities and scientific research institutions across the country to help universities and scientific research institutions accurately grasp the base number of inventory patents." Shen Changyu said that the China National Intellectual Property Administration, in conjunction with the Ministry of Education and the Chinese Academy of Sciences, organized key universities and scientific research institutions to take the lead in carrying out pilot projects, forming an exemplary driving effect. Ge Shu, Deputy Director of the Patent Office of the China National Intellectual Property Administration and Director of the Strategic Planning Department, revealed that in 2023, the number of invention patents granted in China's core industries of the digital economy will reach 406000, accounting for half of the total number of invention patents granted in the society at the same time, with an average annual growth rate of 21.0% in the past five years. As of the end of 2023, a total of 155000 domestic enterprises have digital economy related invention patents, an increase of 31000 compared to the previous year. The effective number of artificial intelligence invention patents has reached 378000, with a year-on-year growth rate of over 40%, which is 1.4 times the global average growth rate. The Third Plenary Session of the 20th Central Committee of the Communist Party of China emphasized the need to accelerate the construction of institutional mechanisms to promote the development of the digital economy. Ge Shu said that the China National Intellectual Property Administration has launched data intellectual property pilot projects in 17 provinces and cities across the country, issued more than 8700 data intellectual property registration certificates, and pledged more than 5.5 billion yuan of data intellectual property financing. At the same time, the China National Intellectual Property Administration drafted policy documents on data intellectual property rights, formulated management specifications for data intellectual property rights registration, designed a nationwide unified data intellectual property rights registration certificate, accelerated the establishment of a national data intellectual property rights registration platform, developed relevant information systems, and made necessary preparations for data intellectual property rights registration at the national level. Talking about the patent open license that has attracted much attention recently, Wang Peizhang, Director of the Intellectual Property Application Promotion Department of the China National Intellectual Property Administration, introduced that since May 2022, the China National Intellectual Property Administration has organized and carried out patent open license pilot projects. By the end of 2023, more than 3200 patentees have screened out more than 59000 patent pilot open licenses, matched and pushed them to more than 110000 SMEs, and achieved more than 17000 license projects, effectively alleviating the dilemma of patent transformation difficulties of universities and research institutions and technology acquisition difficulties of SMEs. On January 20th of this year, the newly revised Implementing Regulations of the Patent Law officially came into effect, and the patent open license system was fully implemented. Wang Peizhang said that the China National Intellectual Property Administration recently issued the Notice on Comprehensively Promoting the Implementation of the Patent Open License System, which will focus on strengthening policy guidance, optimizing service content and improving supporting mechanisms. At the same time, the China National Intellectual Property Administration issued the Measures for Dispute Mediation in the Implementation of Patent Open License (for Trial Implementation) to guide the parties to properly resolve various disputes encountered in the process of patent open license, actively coordinate with relevant departments, implement the provisions of the Patent Law, reduce the annual patent fee during the implementation of open license by 15%, and further mobilize the enthusiasm of the obligee to implement patent open license.
