Beibei, Chongqing: Judicial advice to support the healthy development of the elderly care industry

Recently, the People's Court of Beibei District, Chongqing issued two judicial recommendations to the civil affairs department regarding the standardized development of the elderly care industry, suggesting that the problems existing in the elderly care industry should be highly valued, and the supervision of elderly care institutions in the jurisdiction should be strengthened to protect the legitimate rights and interests of the elderly. It is reported that the Beibei District Court found in a series of disputes involving a nursing home in its jurisdiction that the nursing home is facing operational risks due to financial and operational issues, and elderly people receiving nursing services may face forced discharge at any time. After judicial research, the court further found that the local elderly care institutions have relatively low market access barriers and lack industry service standards, which may harm the legitimate rights and interests of the elderly and affect social stability. Therefore, the Beibei District Court conducted a detailed analysis of the problems existing in the elderly care service industry and put forward targeted suggestions on standardizing elderly care contracts, establishing industry associations, and strengthening supervision and management. After receiving judicial suggestions, the civil affairs department attaches great importance to and actively responds to them, guiding various elderly care institutions in the area to improve service contracts, strengthen industry self-discipline construction and supervision, and cooperate with the court to jointly resolve disputes over elderly care service contracts at the source.
