The Supreme People's Court held a press conference today to release the overall situation of cross enforcement work in the people's courts, and to announce typical cases of cross enforcement in the people's courts. Cross execution is an innovative working method adopted by people's courts in recent times for the execution of major, difficult and complex cases and long-term unresolved cases. Huang Wenjun introduced that since the Supreme People's Court deployed cross enforcement pilot work in 19 provincial (district, city) courts in October 2023, courts in various regions have actively used methods such as supervision and execution, instruction execution, hierarchical execution, centralized execution, and collaborative execution to carry out a total of 72843 cross enforcement cases, achieving substantial progress or resolving 23119 cases, with a total amount of 39.891 billion yuan in enforcement. The reporter learned from the press conference that the largest intellectual property case to be executed since the establishment of the People's Republic of China, the "melamine" execution case, has been upgraded and executed by the Chengdu Intermediate People's Court in Sichuan Province, supervised by the Supreme People's Court, and coordinated by nine courts in four levels, three regions, and nine other regions. On January 28, 2024, an execution settlement was reached, and the relevant litigation and execution cases were resolved together, achieving a good effect of executing one case, protecting both enterprises, and promoting the economic development of the two regions. Huang Wenjun introduced that since the beginning of this year, the completion rate and completion rate of court enforcement in China have significantly increased year-on-year, and the quality and efficiency of enforcement have continued to improve. From January to June 2024, a total of 24828 cases of petitions and petitions were handed over by court enforcement departments across the country, with actual progress of 12702 cases, accounting for 51.16%, and new achievements made in the work of "responding to any trust". The execution case of a financial loan contract dispute between a certain bank's Shanghai branch and a hotel management company in Shanghai was released this time. The debtor, a hotel management company in Shanghai, refused to deliver and continued to occupy the hotel in question due to reasons such as objection to the execution case being reviewed and nearly 200 employees needing to be resettled. Through five rounds of collaborative execution by the Shanghai Higher People's Court, Shanghai Financial Court, and the People's Court of Hongkou District, Shanghai, where the real estate is located, nearly 200 enforcement officers were dispatched, and local public security, human resources, cultural tourism, health, and street departments provided full assistance. The evacuation work was carried out step by step, and group conflicts were properly resolved. Finally, on May 30, 2024, the hotel in question was successfully delivered to the buyer, fully demonstrating legal authority. "Since the pilot program, courts across the country have collaborated to promote enforcement and further crack down on evasion of enforcement." Huang Wenjun stated that this leaves those who evade or resist execution with "nowhere to hide" and "nowhere to do". The people's court pays attention to overall planning while enforcing in accordance with the law, ensuring the realization of the right to win the lawsuit and promoting the stable development of the executed enterprises. The series of execution cases of a certain mining company in Inner Mongolia released this time have been carried out by the Intermediate People's Court of Xilingol League in Inner Mongolia Autonomous Region, adhering to the concept of good faith and civilized execution. The case has been upgraded and centralized execution has been carried out, adhering to the principle of "releasing water and raising fish", helping the executed enterprises to resume work and production, and resolving debts in a centralized manner. A total of more than 240 million yuan has been executed, and the creditor's rights of upstream and downstream private enterprises have been protected in accordance with the law. This is also a series of labor dispute execution cases related to a certain electrical company in Suzhou, which involves 33 labor dispute cases and 44 workers. Through centralized execution by the People's Court of Gusu District, Suzhou City, Jiangsu Province, a property distribution agreement has been reached, and all labor dispute claims have been fully compensated, continuously improving the sense of gain for the people. Huang Wenjun stated that the People's Court has also conducted a focused evaluation of cases where substantive progress has been made through cross enforcement, investigating whether there are issues of passive enforcement, delayed enforcement, and corruption in enforcement. If problems are found, they will be held accountable in accordance with the law and discipline, forcing the enforcement ecosystem to improve.
