China feeds nearly 20% of the world's population with 9% of the world's arable land. Therefore, strengthening the protection of intellectual property rights in the seed industry is an important part of maintaining the safety of the seed industry. Faced with situations such as concealed infringement, significant increase in disputes over variety rights, and complex types of infringing parties, the Supreme People's Court has released four batches of typical cases of judicial protection of intellectual property rights in the seed industry since 2021. This has condensed the wisdom of frontline trials, clarified the application of relevant laws, and timely solved the problems of rights protection that arise in practice while adhering to strict protection, providing strong judicial protection for promoting innovation in the seed industry. A good market environment is the "black soil" for the revitalization of the seed industry. Fake and inferior agricultural inputs such as "fake seeds" and "fake seeds" that enter the market will not only make the sweat of farmers go to waste, but also disrupt the normal market operation order. In order to solidly promote the revitalization of the seed industry and the purification of the market, the Ministry of Public Security, together with relevant departments, has jointly deployed a national special campaign to crack down on counterfeit agricultural inputs. It has organized national public security organs to crack down on prominent criminal activities such as seed fraud and infringement in conjunction with the "Kunlun 2024" special campaign, effectively safeguarding the legitimate rights and interests of farmers. The healthy development of enterprises can provide strong support for high-quality promotion of seed industry revitalization. To further stimulate the vitality of enterprises, on the one hand, in conjunction with the special action of "procuratorial protection for enterprises", procuratorial organs in Hubei, Liaoning, Gansu and other regions have deepened their efforts in seed industry enterprises, carried out "legal medical examinations", and strengthened the comprehensive performance of procuratorial functions in criminal, civil, administrative, and public interest litigation; On the other hand, judicial administrative agencies in Beijing, Zhejiang, Fujian and other places actively provide high-quality public legal services. By signing notarization service cooperation agreements with seed industry associations, organizing lawyers to enter enterprises to answer questions, and preparing legal service guidelines related to seed industry production activities, they help seed industry enterprises achieve significant results in optimizing their layout, strengthening technological innovation, and improving their ability to ensure seed supply.
