Protecting the Rights and Interests of Workers with the Power of the Rule of Law

This year marks the 30th anniversary of the promulgation of China's Labor Law. On July 5, 1994, the Labor Law was passed by the 8th meeting of the Standing Committee of the 8th National People's Congress, and to this day, it provides legal protection for the rights and interests of workers, running through China's legal process like a red line. Laborers are an important driving force for economic and social development, and they have created tremendous value for society through their hard work. Protecting the legitimate rights and interests of workers is of great significance in adjusting labor relations, establishing and maintaining a labor system that adapts to the socialist market economy, promoting economic development and social progress, and so on. In recent years, in order to safeguard the legitimate rights and interests of workers, political and legal organs have made full use of various ways of performing their duties to handle every case with high quality and efficiency, and solve the urgent and difficult problems faced by workers. The Supreme People's Court is based on and extends its judicial functions, strengthens judicial guidance, issues the Interpretation on the Application of Law in the Trial of Labor Dispute Cases (I) and typical cases involving labor disputes, and takes multiple measures to implement China's labor employment and social security system, promoting new achievements in judicial work and source of litigation governance; The Supreme People's Procuratorate, in conjunction with the All China Federation of Trade Unions, has issued a notice on the coordinated promotion of the use of the "one letter, two documents" system to protect the rights and interests of workers. It has launched a special action to "safeguard people's livelihoods" and clearly identified "actively participating in the special action to root out wage arrears, strengthening legal supervision of civil and administrative trials and enforcement activities, and punishing malicious wage arrears in accordance with the law" as a key task. As human society gradually enters the information age, new technologies and applications such as artificial intelligence, big data, and cloud computing are rapidly developing, giving rise to many new economic models and employment forms. Under the new form of employment, the work freedom and autonomy of workers have unprecedentedly increased. Correspondingly, traditional labor relations models and management norms have been broken, and the connotation of protecting the rights and interests of workers is also calling for keeping up with the times. The Ministry of Justice attaches great importance to the protection of the rights and interests of workers in new forms of employment: on the one hand, expanding the awareness and coverage of legal aid, guiding local governments to make new forms of employment workers a key group of legal aid, including the confirmation of labor relations in the scope of legal aid matters, and guiding workers to rationally protect their rights in accordance with the law; On the other hand, establishing a collaborative mechanism for legal aid in different regions can reduce the cost of protecting the rights of workers in new forms of employment in different regions and improve the quality and efficiency of aid services. In January of this year, the Ministry of Justice and other departments jointly issued a notice on strengthening the one-stop mediation of labor disputes in new forms of employment, exploring the construction of a one-stop and diversified joint mediation model for labor disputes in new forms of employment, doing a good job in various mediation linkage work, working together to resolve labor disputes in new forms of employment, serving the standardized, healthy and sustainable development of the platform economy, and maintaining harmonious labor relations and social stability. Protecting the legitimate rights and interests of workers is not only related to the survival and dignity of individuals, but also to the high-quality development of China's economy and long-term social stability. Only by providing more comprehensive legal protection can we continuously enhance the sense of gain, happiness, and security of workers, making glory belong to the workers and happiness belong to them.
