Starting from the 12th Standing Committee of the National People's Congress, the formulation of the Energy Law has been included in the legislative plan of the Standing Committee of the National People's Congress for three consecutive terms. Since the initial solicitation of opinions, the draft Energy Law has undergone repeated revisions and improvements. Recently, the draft of the Energy Law made its debut and was submitted for review at the 9th meeting of the Standing Committee of the 14th National People's Congress. Energy is a fundamental element of economic and social development, and energy security is related to economic development, social stability, and national security. China is a major energy producer and the largest energy consumer in the world. At present, China has formulated multiple separate energy laws and regulations, including the Electricity Law, Coal Law, Energy Conservation Law, Renewable Energy Law, and Urban Gas Management Regulations. However, there is still a lack of a fundamental and comprehensive law in the energy field. The formulation of energy laws and regulations on the basis of single line energy laws and regulations is an important measure to strengthen legislation in key areas, which is of great significance for promoting high-quality energy development and ensuring national energy security. This is a fundamental policy to further improve China's legal system in the energy sector and effectively respond to energy development risks and challenges. The formulation of the Energy Law is timely, especially since the reform and opening up, especially in the new era, China's energy development has achieved historic achievements, providing strong support for high-quality development. At the same time, China's energy development still faces many problems and challenges, such as rapid increase in consumption, continuous pressure on supply security, incomplete adjustment of energy structure, need to improve the level of clean and efficient utilization, inadequate energy market system, and shortcomings in scientific and technological innovation. In particular, the external environment for ensuring energy supply is becoming more complex and severe, with an increase in unstable and uncertain factors. To effectively address the above-mentioned issues and challenges, it is urgent to further improve the energy legal system, and play a positive role of the rule of law in consolidating the foundation, stabilizing expectations, and promoting long-term benefits. The draft Energy Law takes promoting high-quality energy development and ensuring national energy security as the main legislative tone, and timely translates the decisions and deployments of the Party Central Committee into laws and regulations. In terms of overall thinking, the draft runs through energy planning, development and utilization, market system construction, reserves and emergency response, technological innovation and other institutional designs, comprehensively consolidating the legal foundation of energy development and security. At the same time, the energy legal system should be based on the actual situation of China's energy and resource endowment, adhere to the principle of first establishing, then breaking, and overall planning, and handle the relationship between energy security and transformation well; Integrate current and long-term policies, measures, and practices in the energy sector that have been proven mature through practice into legal systems, adapt to new trends in energy development, and enhance foresight and leadership. Taking into account the wide range of energy law regulation and high social attention, it is important to ensure smooth coordination and coordination. During the review of the draft, some members of the Standing Committee believed that the draft made provisions on fundamental and major issues in the energy sector from a legal perspective, and the overall framework and content were basically feasible. This legislation is based on the single line energy laws and regulations to formulate the Energy Law. Therefore, how to effectively connect with other laws has become a hot topic of discussion. Some members of the Standing Committee suggest that the legal revision work related to the energy sector should be considered comprehensively to ensure that the relevant legal system can be connected and matched, and to avoid inconsistent provisions in different laws regarding the same matter.
